Hi guys,

I've got an email from a friend who is not a thaivisa member an he asked me to post it here on his behalf:

"Can you help me to find the information for non immigrant “O” visa extension for retirement from about 4/5 years ago? There was a new rule that everyone applied for an O visa before first of October 1997 needs in his/her bank account 400.000, - Bath or eagle income like state pension, The one applied after first of October 1997 needs 800.000, - Bath. This was also mentioned in the Bangkok Post and Phuket Gazette. I don’t know the exact day and nobody can help me."

I know that this guy never left Thailand for over 16 years, therefore he believe he's entitled to apply for an annual extension with the past requirements.

There is a provision that the old rules apply to persons who consinuesly stayed in Thailand AND stayed on an extension based on retirement. It does not apply to persons who for instance stayed in Thailand based on marriage and now want to switch to an extension based on retirement.

Look under 2.22. As said, it is only for old cases (from before October 21 1998)

In English:

(1) The alien has obtained a temporary visa (NON-IM);

(2) The applicant is 50 years of age or over;

(3) Proof of income of not less than Baht 65,000 per month; or

(4) Account deposit with a bank in Thailand of not less than

800,000 Baht as shown in the bank account for the past 3 months

at the filing date of the application. For the first year, the applicant

should have that amount in his bank account for not less than 60

days or

(5) Annual income plus bank account deposit totaling not less

than Baht 800,000 as of the filing date of application

(6) For an alien who entered Thailand before October 21,

1998 and continuously allowed to stay in the Kingdom as a

retiree, the following shall apply:

(a) He/she must be 60 years of age or over and has regular

income. His/her bank account deposit shall not be less than Baht

200,000 a year and evidence of the account deposit for the

previous 3 months must be shown; or he/she has a monthly

income of not less than Baht 20,000.

b. If he/she is under 60 years of age but not less than 55,

the alien shall have regular income with a bank account deposit

of not less than Baht 500,000 a year and evidence of the

account deposit for the previous 3 months must be shown, or

he/she has a monthly income of not less than 50,000 baht

(6) For an alien who entered Thailand before October 21,

1998 and continuously allowed to stay in the Kingdom as a

retiree, the following shall apply:

(a) He/she must be 60 years of age or over and has regular

income. His/her bank account deposit shall not be less than Baht

200,000 a year and evidence of the account deposit for the

previous 3 months must be shown; or he/she has a monthly

income of not less than Baht 20,000.

b. If he/she is under 60 years of age but not less than 55,

the alien shall have regular income with a bank account deposit

of not less than Baht 500,000 a year and evidence of the

account deposit for the previous 3 months must be shown, or

he/she has a monthly income of not less than 50,000 baht

Something I have wondered about when reading this section. Someone who was 55 year old and had a retirement extension under the old rules would have been required to have income of 50,000 baht or 500,000 baht in bank account deposits. This person would now be over 60 years old and as the rules are written would now only require 20,000 baht income or 200,000 in bank account deposits, so in effect less than what was required of him when the rules were changed.

Is this actually how it works, or would he be "frozen" at the 50,000/500,000 baht level?
