How would you feel if members of the public continually used your garden as a short-cut?

If it's private land, a fee is fair enough.

Well If it was my land I would block the way I agree ypu don't want everyone coming over your land , but then it comes down to the land department should not allow whole beaches to be blocked by private land owners,it's becoming a problem in many places over here where you cannot find public access to beaches ,

We have the same problem in krabi,I was told that resorts are supposed to leave a 3 meter gap on their border for access but obviously no one complies to this.

It's not news:

And there is a law-loophole:

http://www.phuketgaz...rticle1166.html

The beach is considered public domain. Consequently, no resort staff are entitled to bodily force or behave in any manner with the aim of intimidating any beach-goer to stop using the beach. It is a criminal offense.

However, accessing the beach is another question entirely. Although the only convenient way to access the beach is to pass through the resort. To be frank, the resort is not under any legal obligations to open the access way to public use.

This is a legal loophole. There is no statute or judgment precedent that deals directly with this crucial issue.
