May 11, 201313 yr applied 10 weeks ago for settlement. my wife got her passport back today and there is no visa in the passport but also no letter for refusal! im not really sure what im ment to do without the letter? is there anyone i can contact about this? when i do get the letter, can i appeal?
May 11, 201313 yr If it's for UK settlement, your wife can appeal, that's assuming she has been refused. You'll have to contact VFS and / or the British Embassy. Have you seen the passport and returned documentation with your own eyes? Edited May 11, 201313 yr by wooloomooloo
May 11, 201313 yr Author no i havent seen the passport or the documents. she said there is no visa, there is just her two visit ones from before. i told her there should be a letter from the UKBA explaining why its been refused. she said she has looked threw everything but cant find one, i made her a look a good few times i have emailed the VFS, i will call them on monday aswell Edited May 11, 201313 yr by hotwinter

May 11, 201313 yr It seems strange and you can only get on to the Embassy or VFS. Might be worth sending an email as soon as possible to get to the bottom of it. I wouldn't assume your wife has been refused until you get a reply.
May 11, 201313 yr Author If the visa has been refused there will be a black stamp on the last page of the passport. she said there was nothing new in her passport, i will get her to check when she wakes up, obviously its quite late in thailand now Unusual there was no letter. this is what i was thinking, i know she was really stressed out though so maybe she missed it being all upset. i can understand if she doesnt really wanna look properly when she feels bad
May 11, 201313 yr If refused she must have been given a written reason for the refusal. No good contacting VFS; they are just a handling agent and the passports etc. are returned to them in sealed packages for forwarding to the applicant. They don't know what's in the envelope so wont know the result and wont be able to tell you anything. Hopefully Paul or TonyM of Thai Visa Express will be along soon to advise.
May 11, 201313 yr Agreed that VFS are unable to answer, but are obliged to forward email correspondence to the Embassy.
May 11, 201313 yr Author i have the number for the embassy but they are not open until monday. also i know its a right pain trying to ring them. im goign to get my wife to check everything again when she wakes up, im sure it must be in there somewhere. going to get her to check for a refusal stamp aswell

May 12, 201313 yr Author morning, just speaking ot the wife and we went threw the paperwork one by one and there is no letter. i got her to check her passport and there is no stamp in the back or anywhere else for refusal! double checked for visa, and no visa. so no visa, no letter and no refusal stamp? confused!!

May 12, 201313 yr Author just to check the refusal letter without doubt comes in the same package as the passport and documents? does it ever come seperate? if refused do they always put a stamp in the passport to show refusal?

If the application was refused then they'd draw a line through it.

The refusal should be accompanied by a corresponding stamp in the applicants passport, that alerts other agencies. In my humble opinion the UKBA seem to have made an error on this occasion. theoldgit
May 12, 201313 yr Administrative mistakes do happen, no one is perfect. There's nothing to say, one way or other, whether the error indicates a refusal or a granted visa. Only once you've received a definitive response from UKBA will you know. Good luck.

If the application was refused then they'd draw a line through it. enevolope had most the documents we submitted, excluding things like copys and the cover letter which i believe they keep, aswell as her passport i keep telling her to check her passport for the stamp but she says there is nothing from the back, all the way up to her last visit visa

In my humble opinion the UKBA seem to have made an error on this occasion. i really do hope this is just an error and everything is ok. even if they give me a refusal atleast then i can do something about it my wife thinks they have just forgot to put the visa in, or seen her last one and thought they had put it in already. the fact there is no refusal letter or stamp has left me completely confused. im heartbroken she hasnt got the visa and lost because there is not much i can do.. its a right head <deleted>! @wooloomooloo yes you are right, all i can do is wait (again) and see what the UKBA say.

May 12, 201313 yr My wife was unlucky enough to be refused last year. In the envelope returned, there was a refusal letter, appeal form, all documents they returned and a black stamp on the last page of the passport. Horrible feeling. Hopefully it won't happen again. G-d knows what happens next. I know you trust your wife, but from my experience, I always collect the passport for my wife from the VFS office, and then returned home with it unopened. Once opened I have browsed through the passport and completely missed the visa stamp. It happens to the best of us. Have you gone through the passport using Skype? So you can see for yourself. I don't want what I said to sound bad, but mistakes are easily made. Hope you are able to resolve your problem and get your wife home. All the best CC
May 12, 201313 yr Author nothign you said sounds bad so dont worry about that there isnt an internet shop for miles but im going to get her to go, its awkward because of the times aswell, heading 4-5 miles threw the emptyness alone at night isnt a good idea. skype doesnt work on her phone as it has no front camera. i have sent her a link to download whatsapp on her phone and asked her to take a picture of every page of her passport and all the documents they sent back. she can be completely useless at times, the language barrier is always a problem even though her english is real good. she relies on her dictionary alot and not having it with her means she cant read much of whats infront of her. once ive seen all the passport pages and all the papers they sent back i will know more
May 12, 201313 yr Wish you all the best. Currently waiting our decision and don't wish your, 'head <deleted>' on anyone. Can totally understand the frustration through the tough communication in the villages. Had enough of broken speach. Could it be a post office mess up? I don't trust them one bit. Maybe the rain ruined all the paperwork and they kept the passport? Just a suggestion. May 13, 201313 yr Author went threw the passport with her on skype and the documents. nothing in there! all copies of supporting documents have gone, cover letter, invite letter from my dad, etc etc application form is gone so it must of been processed IMO paul from thaivisaexpress got a reply from the embassy asking for him to return the passport and he is taking it back for us on friday. we still dont know if she has a visa or not. so the wait begins again! massive thank you to thaivisaexpress for there help so far, they didnt have to help but have been fantastic!
