I'm looking for advice, on Saturday night I had a road traffic accident in Siracha, Thailand, knocking down a girl who ran out across 3 lanes of traffic in front of me.

We stayed at the scene assisting with the first response and then the police.

The girl has had an operation for a ruptured spleen, lost her front teeth and several cuts and bruises.

I went to see her on the night and again the following day, I have spoken to her mother who lives in Sweden and everyone is calm and the situation is amicable.

I intend to see her again today.

I have been found not at fault, but until the girl is released from hospital or her parents say all is OK my passport remains at the police station.

I wish to travel back to UK on the 12th with my partner but until I get my passport back I am uncertain as what to do.

Is there any help or advise you can give me?

Talk to your insurance company.

already sorted with them for the girls stay in hospital and the repair on my car but won't get involved with police procedure.

Demand your passport back, why are they keeping it ? Are they aware your insurance company is involved ?

This is outrageous if it stops you from flying.

This sounds familiar.

The family don't want you going anywhere without paying first. My guess is around 100k will be asked.

Contacted the embassy now waiting for their reply, I've spoken to her mother and she is better off than me living in Sweden.

Apparently the police are right to keep the passport until the girl leaves hospital or the case is closed.

It does not sound like you have officially been deemed "not at fault". Should you not be speaking to a Thai lawyer rather than a bunch of internet farangs?

In a moment of stupidity I thought I may just get something useful from this site, but as you say indirectly, I'm wrong.

The copper was very good, the mother also, the insurance guy great and has sorted everything at the hospital and more.

I'm just worried as to how long this is going to take, but I'm not due to fly until end of the month.

Why bother posting here then? Have you bothered doing a search of the forum for similar topics?? No.

You are just here for a quick fix, you couldn't even contact your own embassy let alone a lawyer.

Really shows your gratitude for people trying to help.

You probably had Por Ror Bor insurance. The cheapest insurance you can buy which only covers 50k third party personal accident.

The Police have no right to keep your passport only a right to keep your driving license.

Were all your documents in order? Because if the Police have admonished you of responsibility the criminal case is closed. If the parents want to pursue a civil case it's got nothing to do with the Police.

Get a lawyer, go down there and demand that they give you your passport back immediately. If they won't then they will give you a clear reason why they won't.

If they start stalling without good reason then get on the phone to the NCPO in front of them and report them.

I have AXA fully comp and what the girl has had done already 50k wouldn't cover it.

Under Thai law they can withhold my passport until the case is closed and that can only happen when the parents or guardian come to agreement with me in front of the police.

There is no agreement to come to. Your insurance is fully responsible and they Police have to decide who is to blame. Do you have a Thai Driving License? They cannot hold your passport under Thai Law unless you don't have a driving license even then it's a bit iffy.

The embassy a lawyer in Bangkok both agree that until the case is closed they can hold onto the passport.

The police only want the meeting between myself and the family, and even then they won't apportion blame. But thai law protects the pedestrian even when they run across 6 lanes of dual highway.

What is taken into account is care, that means if I was going fast or driving without due care, was she crossing in a safe place, did she look or had she been drinking.

We will see!
