Koh Tao murder report: Prosecutors seek changes

WARNING - HEARSAY post.

So, this is what the CSI guys have been hearing from folks on the island, please don't bite my head off for posting rumours, but in the absence of cold hard facts I think its interesting at least to hear what people who are scared to speak publicly are willing to whisper in secret, make of it what you will.

Sean was indeed tight with Nomsod and family - he worked in their bar, we all know that much.

People have alleged that both Sean and Nomsod are known to gangbang tourists, sometimes using date-rape drugs. Nomsod's English is not so good so Sean was a good middle man, as someone put it.

We also know that Sean has a sexual offence in his past. I SAY AGAIN - I'm posting what I hear, if you DON"T LIKE IT then skip my post.

Also, Sean is still alive because he uploaded a song to his Soundcloud page 4 days ago. I have already sent him a message asking him to speak out

many people are of the belief that is exactly what happened.

When the little girl was killed and thrown from the train and the police thumped the accused around a bit for his confession, nobody cared or tried to tuen him into a victim or say his confession didn't count.

Why do so many here want to make these potential killers into victims?

Does Burma not have any violence? Why is it so impossible for some to fathom that these confessed killers could not have done this crime?

Now their high fallutin attorney has arrived and started a defense lime every attorney does everywhere. Do the numerous defenders of these two accused always believe what a defense attorney says about their client?

Has anyone presented photo evidence of physical abuse?

A very good point!!!

Did somebody (defence lawyer?) not describe their bodies as being in a pitiful state from the vicious police torture, from having boiling water poured over them and them being severely bruised from the beating that they supposedly received from the police (and the translator??).

Why have photos not appeared of their bodies then in this age of camera phones, if true!!!

I would have thought that it would have been circulated around the world (if true) by now!! It wouldn't prove anything anyway as they could simply punch each other rather hard a few times and claim that the police did it.

I've got to wonder what's in 850 pages if there isn't enough "crucial information?"

When I wrote reports, it was limited to crucial information. Yep. 100% crucial, or it does not get included.

Anything else would be, like many of the posts in this thread, what's commonly referred to as "superfluous."

There were over 100 investigators.

850 pages is not that much when you consider how many interviews would have been conducted, how many alibis verified, etc, etc.

They include every detail lest they be accused of cover-up and lack of transparency and now instead they are accused of providing too much detail.

.

They weren't accused of providing too much detail. They were told to clean up the report, and to put something damning in it.

Another guy totally lacking law enforcement experience, who suddenly knows how to write a report on a double homicide, for submission to the prosecutor's office.

The report contained alibis? You are very funny man.

Prosecutors don't need alibis to file charges. That might come later, but not now. What they require now is a level of probative fact to feel assured they have a chance of getting a conviction.

They also need a well-written report, that won't be the laughing stock of the rest of the world.

They got neither. Just more evidence of a shoddy, incompetent investigation, with likely also enough loopholes to get the prosecutor jammed up.

Thank you for making my point.

You couldn't be more wrong bullwinkle.

I was responding to the poster I quoted who indicated the report contained too much detail.

Furthermore, if you don't think any of these 850 pages contained the results of police investigations and interviews then you are not as sharp as you pretend here on TV.

Since you appear to be offended by my posts may I request you atleast read and comprehend them before you sputter out an argument and attempt insult.

Think you can manage that?

Declaring ones innocence does not make one innocent.

Not sure about other countries but the US is chock full of prisoners who declare their innocence.

Not saying they did it not saying they didn't.

Only saying recanting a confession is not proof either way.

Since the possibility continues to exist that they did commit this horrendous crime, I am not going to extend my sympathy to them.

I will leave that to the posters here who really want to see a Thai convicted.

Well, having a confession is an admission of guilt.

Pleading not guilty is not a stamp of innocence. That said. If they have recanted and there is now a request for more evidence it isn't looking like a water tight case is it.

Moral of this story is obviously admit nothing and get your embassy and a lawyer involved asap, before they start pulling your nails out and you sign a confession.

In a serious investigation a confession means nothing as there are several reasons why an accused may want to confess.

In a serious investigation all facts and suspects need to be probed, and all witnesses questioned, until the investigators are able to produce a solid reconstruction of the events.

Why did these two suspects wish to provide false confession to a crime that can likely result in the death penalty?

And havent the news reports stated they were probed, witnesses were questioned and the crime was re-enacted at the location it took place?

Well somebody raped and murdered them.

Who do you think did it, just out of interest??

David got into a argument at some Mafia type Thias bar.. He was defending her hourner became some locals were hitting on her.. They took offence to David defending her.. followed them out of the bar and did them in.. The murderes are mates with the owner and all the locals are too scared to dob them in.

Plausible, I suppose. But so are a lot of other scenario's.

The 2 Myanmar illegals fancied her from seeing them in the bar. Got drunk, followed them to the beach, saw them canoodling, got aroused by this and thought that they would rape her, which they did. Thought it would be a good idea to kill them to hopefully stop them being identified and ran back home hurriedly to where they were staying only to wake up and give the impression as if nothing had happened after they realised the significance of what they had done!!!

Were these two tortured for a confession?

Did they have to masturbate for the police to collect sperm?

Are they facing the death penalty?

This is martial law. Media are only allowed to report what they are told to report. These two suspects need legal representation that will defend them.

Why is the General directing the media in saying not to report which country they are from. Could the General be called into court by the defence lawyer' and have his comments examined over the period of the investigation?

If the prosecutors are saying the police brief is not good? It sounds as they are not happy to represent the state on the evidence being presented?

The more this goes on the more questions come up. Sounds like swiss cheese?

If these two accused didn't do it, then there is still a homicidal maniac on the loose somewhere on this planet.

only one?

I certainly think its possible that these Burmese men are guilty of rape if not murder. However neither the apparent confessions or police statements seem at all convincing. I seriously doubt that only 2 persons are involved and I would speculate that a certain Scotsman and a certain bar manager , might be able to enlighten us further.

The Newspaper that sports the name of the Capital has just issued an interview with Khunying Pornthip. And to pre-empt anyone who claims she has lost credibility when she claimed the Bomb detectors were all above board - Her field is forensic pathology, not the integrity of such hardware devices

She say the Police are at fault because they didn't engage the services of a forensic pathologist.

"By doing all crime-scene and victim investigation themselves, police contradicted the principles of forensic science, she added. "

"He said they told him they had not used condoms while sexually violating the female victim, contrary to earlier police statements that sperm carrying their DNA was found on the outside of condoms"

Let me help you complete the sentence:

They insisted that they didn't wear condoms whilst they raped her!!!

Sorry!! just realised, that bit was near the beginning of the sentence - do you not understand what this means?? surely you can't be that ignorant!!

Why is each of your posts so full of glee? Have some respect you are talking about two murdered people this is not a <deleted> game show, there is no prize for thinking correctly about who murdered two innocent people.

SICHONSTEVE is truly a heartless scum.

So you think that protecting the likely killers is showing respect for the family!!

I think he's saying that being a little more thoughtful with your word choices and how you phrase things would show more respect. I think he's kind of right about that to be honest.

I've been following this case since it broke. Rick182's scenario is a lot more plausible than Sichonsteve's. A big factor, to me, is the murder weapons. Cops don't seem to care, but other than the hoe, there must have been a small dagger-like weapon. Cops don't seem to have gotten to first base with that, let alone looking for anyone who may have been known to have such a weapon. Instead, cops started discounting the hoe saying it had none of David's blood on it. Then, in the reenactment, they were using the hoe to kill David. A stick was mentioned, but that idea was abandoned. The cops disregard Sean and anything he's said or might say as a witness, after the cops weren't able to frame him with the murder, as they tried early on. The 3rd Burmese as witness could be interesting. He started singing from the cop's hymnal (probably after being tortured to toe the line), but is now speaking closer to the truth. Don't be surprised if the cops drop him like a led balloon because he no longer fits with their frame up.

But the biggest reason I don't believe it's the Burmese, is how the cops have dropped some suspects who should still be prime suspects. You know who I'm referring to. Oh, ....and the DNA trail which has become tattered and not believable. Thai officialdom let their eagerness to wrap the case up (and preclude implicating rich Thais or fellow cops) - trump professionalism and any semblance of trying to find the real murderers.

Hang on a mo pal!!!

We are not defending the police. They have cocked up all along and continue to do so and I don't have a good thing to say about them. Have I made myself clear on this point?? Again - WE ARE NOT DEFENDING THE POLICE IN ANY WAY and they have excelled themselves with their incompetence regarding this investigation!!!

We are of the opinion that these police cock ups have clouded your judgement on the issue and you have given the sympathy vote to these men masquerading as poor, helpless, angelic looking, persecuted, boys that are being touted as scape goats.

Are we not allowed to differ with your own personal opinion of events?? Are you that positive that you have got it right and surely it doesn't disturb you so much just because we happen to disagree with you.

Keep putting forward your opinion but let us choose ours. Time will tell who has got it right, after all, with all of the kerfuffle you media-warriors have generated a cover up looks highly unlikely now, agreed on this point?? On account of this, the truth should come out so just let events take their course and stop criticising us for having alternative views to you.

Got it???

Look at your timeline and you're missing something. After they, supposedly, got drunk and followed them to the beach because they "fancied her", they also stopped to buy beer, sit and play guitar, sing songs (with their thrid friend) all before raping her and killing both of them?

My goodness, you absolutely qualify for categories 1,2 & 3 of my previous post, don't you?

You demonstrate a serious lack of intelligence bordering on retardation. I can't be cruel, just understanding but, given your (now) obvious shortcomings, why don't you leave the serious discussion to those of us with an IQ over 50?

Going on posts by SteveFong this is exactly how it went down iny opinion

*There was an argument in the bar. Mon and co were rejected ( I believe one is police and one influential islander). Later that night whilst on the beach in a group Sean, having been asked by Mon and co for his help, has lured Hanna away behind the rocks so Mon and co could have their way. David on the beach hears her struggle, probably screams and has gone to help and been assaulted with knuckle knife and dragged to the water and drowned.

Sean who was OK with the girl being raped tried to stop Mon and co beating and killing his friend and has been struck and run for his life also. Mon and co have finished the rape buy because she has seen David murdered needs to be killed herself so she can't id Davids killers. Mon runs the other 2 stay on the island again I believe as police and influential islander to contamenate the scene, remove all evidence of their involvement and help the investigation lead somewhere else, plant new evidence to find a patsy ie cigarette butt of the accused, phones etc etc.

No patsy is easily found so they go after Sean, hence the comment u have blood on your hands when they catch up with him in 7/11 and or the minimart. Fearing for his life and now with witness to being chased and being able to post on FB who was chasing him he calls police. Police come to help and knowing now that he has posted on FB and created a scene have to protect him.

Sean gets off the island with help of journalists but is interrogated on BKK by police. Not because they think he did it but to make sure he Nevers opens his mouth RR the truth. Agreeing to this he is allowed to leave Thailand as are David and Hannah's friends. They have all been told and or threatened to keep their mouths shut.

SteveFong and u people who were there how close am I. I reckon that's it.

What's happened since with BK air and the Uni is just all apart of the cover up money chain etc. Mon was on the first flight out. He was never in school and all of this just goes to show u how evil this whole thing is. Thai authorities are prepared to maybe executed 2 innocent people so 3 weak pric#s could get there rocks off and save some face.

You know the saying AMAZING THAILAND.

Hannah and David left the AC Bar together

Im sure one of her pals said this hence Hannahs phone was in her handbag

I don't believe I mentioned you in my post above but, if the cap fits............Also, had you read the post, you would have seen that nowhere had I given my "sympathy vote to the two guys, in fact I said that should they be competently proven to be guilty, they should hang!

The police cock-ups have not clouded my judgement on the issue, but have clouded the issue itself.

I don't have a personal opinion of the events but would like to think that I , and the Thai population, have the right to live in a country where the police are reasonably competent and straightforward enough to give us a true picture of the events and carry out a thorough investigation without fear or favour.

As for me being a "media warrior", lol. Look at your number of posts and then compare them to mine!

Get it? Got it? Good!

All Thais over the age of 16 are aware that Thais from very rich families are essentially untouchable in regard to breaking the law. It's a fact of life in Thailand. Similar to police. Even if a policeman gets found guilty of a crime, (after his buddies do everything and more to try to shield him from due process), ...even if the cop goes to a jail, it's almost assured he'll be clandestinely let out the back door some moonless night when no one is looking. I could list several prominent examples, of both the rich Thais and of cops, but those familiar with how things transpire in Thailand, could do the same.

With that in mind, it's understandable that a rich kid (with or without a cop friend) could go berserk with a tiny portion of his brain knowing he was untouchable.

I will say again, the girl that was killed would have put up a fight !!!!! Tha male has DEFENSIVE WOUNDS ON HIS HANDS !!!!!

These two little runts would be all beat up and they have little baby faces.

What do the accussed weigh ? Maybe a buck 40 soaking wet. Come on, in pattaya when there is a misunderstanding over a bill they call in the Mafia thugs to beat up a 60 year old man.

So what happens when a girl disses the island rich kid that can not get any island girls because he is known for raping and beating up the bar girls.

Sounds like the making of a good movie.

You really shouldn't be throwing accusations about.

I and I'm sure most if not all of my fellow 'Brits' would be happy to see a 'Brit' hang for this crime if a 'Brit' has committed it.

People want to see justice whether British, Thai or Burmese.

All leads point to it being done by Thai people, but if this Sean guy had a hand in it also I'm happy to see him swing.

Accusation?

All leads point to thai people?

Please elaborate.

You feel a sharp smack on the back of your head.

You recover and turn around.

There is one man standing there with a red palm.

You ask him for a DNA sample from his hand to match scalp and hair from the back of your head.

He says no.

You say OK, and wobble away.

We say B/S and that all leads point to him.

Clear enough?
