Visa on process, old one overstay, please help

My wife currently works for a 'branded' hotel company and has for four months now. Her long term visa has been on process for 6 weeks via the hat yai office (we live in Phuket). For various thai reasons (someone important was on holiday ect..) , this has taken a lot longer than expected. So she has now overstayed her temporary visa (which her hotel had already extended once) waiting for her new visa to be processed. She is currently 7 days over and we plan to get her out in 2 days so a total of 9. Being law abiding expats, she went to immigration in Phuket town to prepay her overstay fine. This was not accepted due to visa on process, nor would they extend her temporary visa. So basically she is now 'illegal' and I am extremely fearful she will be thrown in jail when we attempt to leave Friday, as an American expat was recently jailed for overstaying one day. What options do we have? How can I protect her? Get her out of here? Her HR department is offering no solution, nor immigration officials. Please help

It sounds like she has an under consideration stamp in her passport. That allows her to stay until the extension of stay application (not a visa) is approved.

The report back date on it is just that. It does not mean the under consideration period has ended.

If she has the under consideration stamp she does not need to leave.

If she was to leave and return she would have to do the extension process all over again by getting a new non-b visa.

Don't believe everything you read.

'Under consideration' is a very standard process here, no need at all to panic and leave.

She is currently 7 days over and we plan to get her out in 2 days so a total of 9.

Can you clarify "7 days over" - over what ? And all the stamps and relative dates, including the entry stamp and "already renewed temporary visa".

The under consideration is the date to check back with immigration. IT IS NOT a expiration date, the process can take a long time. If extension of stay not completed by IM, them will stamp another date to come back to check with them, As advised if you leave the country during this period, before the process is completed. You have to start all over, and I do mean ALL OVER. Have patience!

I had the same issue a few months ago. She is not on overstay and what ubonjoe saga is correct.
