NLA to consider Yingluck’s impeachment case‏

BANGKOK: -- The National Legislative Assembly will meet on November 12 to discuss whether the assembly has the authority to consider the impeachment case against former prime minister Yingluck Shinawatra or not.

NLA president Pongpetch Wichitcholachai said today (Wednesday) that even if the 2007 Constitution was already revoked since the May 22 coup, the National Administration Act B.E. 2534 and the National Anti-Corruption Commission Act are still enforcible.

The NACC charged Ms Yingluck of violating Article 11 of the National Administration Act and Article 58 of the NACC Act as well as Article 178 of the 207 Constitution for failing to stop corruption in the rice pledging scheme causing extensive damages to the country. It has demanded her impeachment.

Mr Pongpetch said even if the 2007 charter was already revoked the NLA has the authority to consider the impeachment case as the two acts are still enforcible.

Meanwhile, Mr Pichit Chuenban, personal lawyer of Ms Yingluck, pleaded with the NLA to be fair with the former prime minister. He suggested that the NLA apply the impeachment case against former house speaker Somsak Kiatsuranont and former senate speaker Nikhom Wirachpanich in which the NLA decided not to consider the case citing the revocation of ay 2007 charter.

Mr Pichit reasoned that since the charter was already scrapped, the two acts which are organic laws cannot be used against the former prime minister as basis for her impeachment.

So the NLA is deciding which laws it will abide by and which ones it won't.

An I thought that's what people were protesting about earlier this year.

Mr Pornpetch told reporters that he issued an order today to include the selection of new prime minister as an agenda for the NLA meeting this Thursday.

Asked whether it is possible for a member of the National Council for Peace and Order to become prime minister, Mr Pornpetch said the Provisional Constitution does not prohibit a public servant from holding a political position.

He noted that a commander-in-chief post is also regarded as a public service position.

The NLA president declined to comment on the possibility that Thai Army Chief Gen Prayuth Chan-ocha might hold two important public positions - one as head of the National Council for Peace and Order and the other as interim prime minister, which is seen by many parties as inappropriate.

After nearly completing a nationwide warehouse inspection, the government has found that about 20 percent of the stocks were missing or rotten, said Rangsan Sriworasart, permanent secretary for the Ministry of Finance and a member of the rice inspection committee.

The Minister in the Office of the Prime Minister has advised that the checking of the government’s rice stock has been completed but the office must now wait for verification of the rice's DNA to end the whole the process.

Now the committee must wait for the rice DNA verification outcome from the Kasetsart University, Kamphaeng Sean Campus which is undertaking the process. Therefore, the Committee has concluded that there will be no press conference regarding the matter until the DNA checking process is complete as well.

The verification process can't be rushed, as the Prime Minister wants the process to be done with all due care and accuracy.

After the process ends, the committee will fully inform the public, said M.L. Panadda Diskul.

They have already set a precedence by citing the 2007 charter being revoked.

This case is dead in the water.

The yellow elite want her head because of her popularity and the people want their elected leader back.

Whether or not they decide to impeach the prime minister of the last elected government of Thailand depends not on interpretation of legal precedents, or the strength of any evidence they may have accumulated, but rather on the extent to which the current government is prepared to "rock the boat".

Maybe we will soon hear Thailands own Nicely Nicely Johnson being told "Siddown siddown siddown siddown, siddown you're rocking the boat!"

BANGKOK: -- Former prime minister Yingluck Shinawatra will face impeachment proceedings for alleged failure to stop corruption in her government's rice-pledging scheme, after National Legislative Assembly president Pornpetch Wichitcholchai said yesterday that the case would be on the agenda of the NLA meeting on November 12.


On October 14, the NLA president said he had accepted the case filed by the National Anti-Corruption Commission (NACC) against Yingluck for her failure to stop corruption and the massive losses suffered by the state in the rice-pledging scheme. He explained that the NACC had found that Yingluck, in her position as prime minister, had intentionally violated Article 178 of the 2007 Constitution, Article 11 (1) of the State Administration Act (1991) and Article 58 of the Constitution Organic Law on Anti-Corruption.

The NLA president said that though there were claims that the charge of abuse of authority against Yingluck was in violation of the 2007 charter, which is now defunct, the suit filed by the NACC clearly indicates why the former PM should be impeached.

"This has led me to believe that the impeachment case should proceed in accordance with the revoked [2007] Constitution and state regulations. Hence, I have instructed [the agencies concerned] that the impeachment case against Yingluck be scheduled as a special agenda on November 12," Pornpetch said.

Copies of documents related to the impeachment case have been sent to Yingluck and NLA members, he said. The former PM could face a five-year ban from politics if she is impeached.

According to the NLA meeting regulation, after the assembly accepts the case it would schedule a date for Yingluck and the NACC to make a statement before the NLA. The NLA would set up a committee if any assembly members wanted to debate or ask questions. After that, the NLA will schedule a date for both the NACC and Yingluck to make their closing statements. Normally, the process will take about 45 days before the vote on whether to impeach or not.

Pornpetch also said that the NLA would meet next Thursday to discuss and decide on whether to accept the impeachment case against former Parliament president Somsak Kiatsuranon and his then-deputy Nikom Wairatpanich for deliberation.

The NACC had ruled earlier that Somsak and Nikom should face impeachment proceedings because they had proposed a bill that sought to amend the Constitution and change the composition of the Senate.

The chairman said the difference between Yingluck's case and those of Somsak and Nikom was that in the ex-PM's case, though the 2007 Constitu-tion is defunct, its organic laws are still in force. He said, the NLA could go ahead with the impeachment process against Yingluck.

Pornpetch said the NLA had earlier deferred making a decision on whether to accept the impeachment case against the previous government's top politicians due to legal technicalities. He added that the assembly would have to vote to decide whether to also accept impeachment cases against Somsak and Nikom.

The assembly chairman explained that some NLA members still harboured doubts over whether the alleged constitutional offences were still valid as the 2007 charter had already been scrapped. Pornpetch said the assembly this time, would make a decision without delay, adding that the NLA had the final say and that there was no need to seek a Constitutional Court ruling on the matter.

So Yingluck is highly likely to be impeached. I am glad to see this, but hope it doesn't stop at her. There are many people in the last government that should be in the dock with her.

Funny how this comes out now.

The same time the authorities release the truth about the scale of the losses with 90% being all but useless in the stockpiles.

Then the finance ministry releasing the data that the scheme has lost between 700 and 800 Bn Baht and will take 30 years to repay.

Now the impeachment hearing news.

If (when) she is impeached, then a criminal case is bound to follow.

All at a time when Yingluck has left the country with her son........ Has she come back yet? If not, then maybe she has been given a heads up to get her ass out of dodge.

She must be shuddering in her boots, terrified of a 5 year ban from politics.

It won't be the impeachment that scares her. It is the possibility of criminal prosecution that could (and should) follow.,

If found guilty and impeached, that will be the NACC's next move.

Considering an article the other day, Prayuth said only 10% of the rice was still good, so her actions may still be costing this country money in rice losses. The stockpiles that are there still, are rotting because nobody wants it. I am waiting the DNA test results that have been ordered to see if that rice is even form Thailand.

how about the fact that only 10% of the stored rice is actually usable and that the scheme is going to cost the Thai people almost 1 trillion baht in losses

If it was up to me I'd make the top tier of the last government pay for the loss from their own pockets then throw them all in prison

Nothing? You seem to forget the 700++ billion Baht debt at BAAC guaranteed by the Yingluck Government. A self-financing scheme gone wrong. A charge of 'negligence' seems rather mild.

The Financial Times (that well known revolutionary rag) - behind a pay wall - simply reports "The Thailand Junta's puppet government seeks to impeach Yingluck under a law that no longer exists".

It's fortunate that on the forum we have a number of cheerleaders to the current Junta who can put us right when ignorant outsiders misunderstand.

Externally, they can see clearly what's going on in LOS. Internally, there are increasing noises like from Paul Chambers of Chiang Mai University said that the puppets in the NLA and their master will probably arranged for Yingluck to be banned from political office. Sadly the NLA is interpreting their own laws to reach their goal but will not be enough to soften the Thaksin camp.

I think it is certain Yingluck will be banished from political life but there's some uncertainty on timing.The Junta and its puppet government are determined to eradicate all remnants of Thaksin but some elements are cautious about taking action too precipitately - because of reactions both internally and abroad.But about the goal there is no argument - that was the objective agreed long ago.

Might as well impeach her because her toy sailors were shooting at red shirt protestors. Might as well impeach Obama for not stepping in to save democracy, why don't we all vote to stop the Clintons living in America. Wouldn't it be great to run the Bushes out of Texas or banish David Cameron to Belgium.

It's the usual pathetic disgrace of the sore loosers who traiterously worked for years to form a plan to use a fat little Musolini to bring in his armed crooks to stir up trouble and then refuse to stop it happening and will use ANY way to twist the law to prevent the legitimate govenment from functioning (even if you hate them they were elected).
