BabyButton Posted January 4, 2015 Posted January 4, 2015 Hiya Iv looked through the posts but can't seem to find this question so apologies if it has been asked before. My husband will be applying for his UK spouse visa in March and is currently here on a tourist visa. At first on this tourist visa he was staying 2 months, but then decided to stay the 6 as at first I didn't have a job and he really was visiting and then we have luckily managed to get into a position that we can apply for the spouse visa and so he decided to stay and be with our son and not return until a few days before his visa expired. I know I have asked a similar question before about staying longer but has anyone done this and had problems when they come to apply for their spouse??? Thanks!!
7by7 Posted January 5, 2015 Posted January 5, 2015 As said to you before, staying longer than originally intended is not a breach of his visit visa conditions. However, it can damage an applicant's credibility in their next application unless the applicant adequately explains why they did so and how they were able to do so; especially if, like your husband, they said they had to return home by a certain date for work. However, as your husband's next application will be for settlement, not a visit, this should be easily overcome in his case by explaining the circumstances in a covering letter.
