Custody Issue? Including Son on IR1 US Visa for Wife (DCF)

Background: I'm a US citizen. Married here in Thailand 5 years ago and we have a son together soon turning age 4. I've lived here the entire time with multiple Non-"O" extensions of stay. We're now planning to move to the US later this year and I'm doing all the reading and researching on that.

Topic: We wish to also include on the application my stepson soon to be age 15 to bring him with us. My wife was not married to his biological father, but his biological father's name is on the birth certificate. The biological father has had no contact with nor supported him in anyway in a dozen years.

My stepson has a passport, but it just occurred to me the fact his biological father's name is on birth certificate could be an issue with him getting a US immigrant visa. Is there something we need to do here for handling that? His biological father would have no trouble finding him and has made no attempt in over a decade, but the opposite isn't true. We don't know anyone who knows anything about his biological father's whereabouts.

Any comments are appreciated.
