Hi

So next week were due to apply for my wife's citizenship through the checking service .

I've received a letter from where we are going and under the requirements in the letter it says that you have to have the ILR for 12 months or more is this correct ? The misses was granted hers last October

I thought they was no restrictions on when you can apply .

Can anyone shed some light on this matter ?

Anyone who applies for naturalisation as British must have no time restriction on their stay in the UK; i.e. ILR or the equivalent.

If applying under section 6.1 of the Act then they must have had this for at least 12 months.

But spouses and civil partners of British citizens apply under section 6.2 so they can apply as soon as they have ILR; provided the other requirements, such as the residential one mentioned by tonyk above, are met, of course.

I suspect it was a form letter you received, or maybe they sent you the one for section 6.1 applicants rather than 6.2 ones.

If you want to be sure, then print out the document linked to above to take with you in case they query it; but I doubt it will be necessary.
