Hi,

My wife is currently on a settlement visa in the UK and is soon due to apply for ILR providing she can pass the Life in the UK test, she's passed the language test already.

If my wife doesn't manage to pass LitUK and has to apply for FLR, will she have to pay the NHS surcharge even though she's working and paying NI?

I know its a new rule so there are still grey areas etc but was hoping someone could give me a little bit of guidance.

Unfortunately I think the NHS surcharge is applicable for FLR but not for ILR. I'd be happy to be proved wrong but I think that is the case.
