My wife's 30 months anniversary of being in the UK will be the 21st of December. We have booked a fast track appointment for the 30th of November. Is this OK?

Also by booking early will this mess us up at the 60 months stage? I'm aware that we can apply up to the last day, I was just thinking in regards of holidays over the next 30 months. Do these holidays get taken from your time spent in the UK?

To qualify for FLR she needs to have been resident in the UK for at least 30 months.

But she can submit the application up to 28 days before this date.

So, from what you say, applying on 30th November should be fine.

This wont mess up her ILR application after 60 months in the UK; the same applies then; i.e resident for 60 months but can apply up to 28 days early.

Whilst qualifying for both FLR and ILR time spent outside the UK is not added on to the residential qualifying period. Also there is no maximum time allowed out of the UK during this time. Though the applicant does need to show that they are a UK resident and have been for the entire period; which may be difficult to do if they have spent more time out of the UK than in!

However, when/if she applies for naturalisation as British then time out of the UK will be taken into account. She must

  • have been physically present in the UK on the exact date three years prior to submitting her naturalisation application; and
  • during the three years up to the application have spent no more than 270 days in total out of the UK with no more than 90 days in the final year.
