Thung Kham gold-mining firm hints at the possibility of withdrawing court case against girl

BANGKOK: Thung Kham gold mining company is ready to withdraw the lawsuit filed against a 15-year old girl if the National Human Rights Commission agrees to bring the girl to settle the conflict with the company, said Mr Akaradet Jo, personal advisor to chairman of Thung Kha Harbour Plc, parent company of Thung Kham.

While welcoming gold-mining company’s initiative, Mrs Toenjai Deethet, chair of the community rights and resources panel of the NHRC, said that it was unnecessary to bring the girl for talks because she would come under pressure.

She said that the NHRC would represent the girl and that should benefit both the company and the girl.

Mrs Toenjai further said she wished the discussion today between her and representative of Thung Kham company should signal a good start for co-existence between the gold mining company and the communities affected by gold-mining activities.

Mrs Toenjai today (Friday) visited the gold-mining site to hear the company’s side of the story from Mr Akaradet had no intention to sue the girl but was forced to do so by law.

Mr Akaradet also said that the legal case could have been settled out of court had the villagers not forced the girl’s school director to stay away from the case.

The 15-year old girl whose identity was withheld because she is a minor told Thai PBS about the sufferings of the people in his community as a result of the effects from gold-mining operations.

Pathetic attempt to save face as is the insistence to have the girl paraded before them in what's likely to be a very intimidating atmosphere despite the false smiles.

I won't ask if the company's hierarchy feel proud of themselves as that would require qualities they don't possess.

Do a search for "gold mining environmental issues" and here's the first thing you see: Gold mining is one of the most destructive industries in the world. So, I'm going to assume the 15-year-old girl has some valid complaints.

But I guess everybody in the establishment is now happy that a loud and clear message has been sent to the (young) people of Thailand to just accept commercial injustices and toe the line -- keep your mouth shut when you see your environment and natural habitats being destroyed by commercial operations because that's what good citizens do,

How gracious of this self-righteous and greedy company to drop charges against this child. Now they can carry on with their poisoning and general destruction feeling good about it.

Mr, Akaradet is the personal advisor to the chairman, no official capacity, no role within the company..., yet: "Mr. Akaradet had no intention to sue the girl but was forced to do so by law"

I think this particular farce needs to be played out, especially as it seems that the gold company's tactics are starting to give themselves a black eye.

There should be a government investigation into this company and the results released to the public, the villagers have been complaining about environment problems and water contamination for some time, this just shows the depths this Thai mining company will go to , to avoid publicity because someone just might investigate their activities and they don't wont that , as to the comment they didn't want to take the young girl to court but the law made them do so if that's the best you can offer no wonder your track record on the environment is like it is, you're all B/S....................................coffee1.gif

Yeah settle it out of court.

By that you mean force this child to apologise for presenting a view you don't want discussed.

Force her to promise not to do so again under threat of legal action.

Force her to shut up and make sure only the corporate line is heard by the public.

maybe they are starting to realize how stupid this is making them look with the prospect of losing the case seeing she now has professional backing and not simply a cheap thai lawyer. Still even with the prospect of losing they still want to save face and have her meet them, can only hope they are made to look as pathetic as they truly are, anywhere else in the world this case would never have been able to be instigated because the girl told the truth but here truth is not important, face is.

Any photos and details of the board of directors of this company?

They should be praised on social media...

Ex Police Chief Somyot was an independant director there until a year or so ago. Also there was a detailed article in the middle of last year that alleged the Crown Property Bureau held a minority stake. As can be seen from this case and the Australian lady a few years back they are not shy about throwing lawsuits around and clearly have serious connections.

They desperately need the girl to meet them so they can issue some BS statement about giving careful thought, being reasonable etc and throwing in something to the effect because the girl withdrew her original statement, expressed regret or whatever it takes to save their face.

What this case needs so very much, is for an organisation like GREENPEACE to get involved, then the mining company really would have a fight on their hands and in the worldwide media. Now that really would be good to watch.

So now they can carry on polluting as before and nobody will dare to open their mouths, maybe it was a clever move by the company after all, an adult must now think,''if they are prepared to sue a school girl what would they do to me''

All Thai companies work on this Philosophy, not only companies the government and its departments as well , seems to be a favorite pass time suing for minor or irrelevant B/S ..........Shuts everyone up, the only other option of course is the disappearing trick.
