Understanding Thai Visa Situation

Featured Replies

I am a UK Citizen by birth and Australian permanent resident. My partner is from Thailand and works now in BKK. I am currently looking to relocate to live in Thailand so our relationship can continue. My partner has a very good job in BKK as an interior designer which by contract has to continue employment for next 2yrs. I am an engineer by trade though for past 9yrs a qualified golf course manager at some of the World's most exclusive golf courses. I am 36yrs old.

What are my options to living in Thailand...any help greatly appreciated!?! Many thanks.

Are you asking for the type of visa on which you can live here or are you asking about chances of finding good employment?

This is now in the correct forum, ubonjoe is most likely offline for the night, he will along in the morning with the correct answers, in the meantime others may try to answer your questions.

You are in that forum now (which is for specific visa related issues) - there seems to have been a delay as I also could not find your post and lost a reply as forum said I had no authorization to post (obviously during move).

a. There is an elite card type program that allows stay - cost is upfront and sizable.

b. There is an investment option for visa - also upfront sizable cost but asset is held such as condo or bonds.

c. If employment with work permit and meeting pay requirements is found you could extend based on that.

d. You can not obtain what is normally used for long stay as too young for retirement (need to be 50) and not married to a Thai.

e. Tourist visas can be used but brings with it requirement for frequent travel to renew and suspicion of working illegally so could be problematic in long term.

You have very few options.

1. Get married.

2. Find legal employment with an appropriate visa and work permit

3. Buy into the Thai Elite scheme.

Thank you everyone for answering so quickly plus putting me in the right forum!...I will shed a bit more light now this is going.

My partners job is a must and she is based now in BKK. I have the flexibility of working contract hrs in Australia or the UK but ultimately I and my partner want to be together obviously as normal daily. Though we are not silly in that she has to settle there and I have to like Thailand to live there also. I have only ever travelled there on holiday and we all know travelling somewhere and living somewhere are two different things!!! In the long term all being well we have spoken of marriage but do you think best for us to marry in UK or Australia then apply for Thailand or marry in Thailand.

A legal Thai marriage is recognised as such in the UK and Australia so where you marry in my opinion amounts to personal choice.

Getting married in Thailand is simple and legal everywhere - you get a letter from your Embassy (UK) and use that (after translation/registration) as proof of your being suitable for marriage and register at any District Office. Not expensive or hard but may need to find old divorce paperwork if that is a factor.

After marriage you would qualify for non immigrant O visas (90 days per entry) and they are available single for valid for a year of trips. Once on such an entry you could extend with 400k baht in a Thai bank for 2 months time.

So unlike the UK or Australia is there no such thing in Thailand as a Spouse Visa which grants you residency? With UK and Australia with such a visa you get temp residency status for 2yrs then that converts automatically to permanent residency status. Many thanks.

No such beast !

The best you could hope for, in the short term, if married to a Thai person is a one year, renewable, "extension of stay". To obtain the extension you would need 400k Bht in a Thai bank or an Embassy certified monthly income of 40,000 Bht. (A one year multi-entry visa based on marriage can also be obtained but requires you to leave the country every 90 days)

Finding well remunerated employment will also be a challenge.

Obtaining residency status in Thailand is a complex and expensive process which can and does need many years of commitment !

No, the only way to permanent residency or citizenship in Thailand is through local employment and paying taxes.

"no such thing in Thailand as a Spouse Visa which grants you residency?"

If you are married to a Thai national and have documents, you could get a non-imm O visa based on marriage to a Thai You'd need to apply for the visa at an embassy outside of Thailand, possible at one of the neighboring countries. You'll get a 90 day entry and during the final 30 days you could apply for an extension of stay based on marriage.

The extension can be applied for at an the immigrations office in Thailand. It has to be renewed annually. You would also need either Baht 400,000 in a Thai bank or proof from your embassy that you earn at least Baht 40,000 per month when you apply for the extension or renew each year.

It is an extension of your permission to stay in Thailand, not a visa and not any form of legal residency, so if you plan to travel in and out of Thailand, you'd need a re-entry permit in addition to the extension of stay.
