Hi guys , my Thai wife was issued a 6 months visitor visa for uk last August 19th, she visited ,stayed 4 months , came back to Thailand , question is , we now want to apply for another visitor visa for her for a similar stay , do we have to wait until August 19th for expiry of old one ? Or can we apply as we still have two months left of old one ? Much appreciated

I can't see a problem here, Humble1. Your Thai wife was issued a six month visa so we can safely assume that the visa has already expired.

In addition, I would imagine your wife has been back in LOS for the last six months.

Apply for the next visit visa at your leisure, but make sure you treat the application as seriously as the first.

Correct wooloomooloo , she has been in Thailand since January , so I suppose as you suggest it is ok to reapply. Thank you very much for your input

As wooloomooloo rightly suggests don't take the application for granted, treat it as seriously as the first application.

You say that your wife stayed in the UK for four months, when she applied for her initial visa did she say that was the length of time she intended staying in the UK?

A 6 month UK visit visa is only valid for 6 months from the date it is issued or the requested start date (which can be up to three months ahead), whichever is the later.

So if your wife's previous visa started from August 19th 2015 it will have expired on or around 18th February 2016; no matter how long she actually spent in the UK during it's validity.

So she'll need another visit visa anyway.

Thank you 7by7 and all replies , I was under the illusion that a 6 month visitors visa could be used as in like two months here then two months there within a one year timescale , so thanks for clearing that up that it is only valid for 6 months from the date issued , luckily we returned before the 6 months were up and never travelled ( or tried to ) again ,

If they had a visa valid for two years is the maximum stay per entry six months and if so how long do they have to stay out of the country between visits?

Yes, they must leave on the day the visa expires at the latest.

Unless the Entry Clearance Officer has valid reasons, agreed by his manager, for restricting the number of entries when issuing the visa, standard visit visas are multi entry.

Long term visit visas can be valid for 2, 5 or 10 years.

Whatever the term, a standard visitor can only spend a maximum of 6 months per visit in the UK.

There is no minimum time which a standard visit visa holder must be spend outside the UK before being allowed to enter again; however there is a convention that a standard visitor should not spend more than 6 months out of any 12 within the UK.

This is not an actual rule; but if an ECO assessing an application or immigration at a standard visit visa holders port of entry have reason to be believe that the person is or intends to use their long term or regular short term standard visit visa for de facto UK residence then their application will be refused by the ECO or they will be refused entry by immigration.

However, if a visitor has an exceptional, acceptable reason for visiting the UK more often than this then they will probably be allowed to so do.

See "Frequent or successive visits: how to assess if an applicant is making the UK their main home or place of work" starting on page 10 of the Home Office guidance to ECOs. (Immigration officers have similar guidance saying essentially the same thing.)
