Hi I just wanted to know if anybody knew or had ever experienced a divorce with a Thai lady and all of the male partners assets were located in Australia. Just curious if anybody knew the legal implications if say you met and married a Thai lady in Thailand under Thai laws and then you had kids and later on down the track you ended up getting divorced but the males assets were in Australia. Does the Thai wife have rights to part of those assets under say Australian/Multi National law?

If the divorce is in Thailand then only assets in Thailand can be counted. However if the Thai wife was to travel to Australia and sue for divorce over there then everything is counted. Generally the Australian courts will look at the length of the marriage to determine who gets what percentage.

if the husband wants to divorce but wants to protect his assets then he needs to get in first and sue for divorce himself in Thailand, because once the divorce process is started then the other party cannot start a second process and the divorce would have to be completed in Thailand.
