Condo transfer problems at Pattaya Land Office?

I know for fact that VT2 qualified as several friends bought under the waiver and are still there.

Normal ...., the problem only arise only when they wish to sell in foreign name ,and if they are NO MORE in the foreign quota , as long they keep the condo for themselves they can keep it .

I would suggest before agreeing to buy, one should check with the Juristic Persons office as to what % is foreign owned. assuming it has a few hundred units the say 48 or less % would be no problem, if 49 percent ask the JP will your purchase go through? if he asks for money walk away as he is as bent as a 9 Baht note, you do not want to buy in to a condominium with a crocked JP.

 

Suggest getting a written guarantee from the seller or JP before parting with any money, including any deposits.

The problem can be that in the past the quota has be exceeded therefore even foreign name to foreign name may be blocked.

That is what many where explaining before already  , only selling to Thai name or company name is possible , hence why latest most adverts shows in company name in VT1 & 2 ....small exceptions advert in foreign name ......

My assumption has been that the reason most adverts show units in company name for VT1/VT2 are that the ones in foreign name get snapped up pretty quickly, leaving the company name ones to languish unsold for a long time, and the list of them keeps getting longer.

 

I know of units transferred in VT2A and VT1B foreigner-to-foreigner that have sold recently with no problem at the Land Office.

Hi. Yes I know that these posts are 1 year old already, but I just found this page on Internet and thought it would be well to give the answer... even after 1 year :wink:

 

So:  Condominium Act No.3 1999 - Temporary measurement between 1999 and 2005

 

and among the rules, you can see :

The total area of the land on which a condominium is situated // shall not exceed five rai;

and also:

the alien obtaining an ownership in this regard and the foreigner receiving an ownership in a condominium unit transferred by the former are allowed to continue holding the ownership in that condominium unit even in a higher proportion than forty nine percent.
