Non-O extension (work)

Featured Replies

1) Is it possible to get an extension based on work starting with a non-o visa? I originally entered on a Non-B a decade ago and have been living on annual extensions so haven't really thought about my original visa in a long time.

2) If it is possible, how would it work if I had a multi Non-O? Could I extend my stay for 1 year in my first 90 days, but then not need to get a re-entry permit (as my visa is multiple entry) or would everything reset if I left without the re-entry stamp and then would just get 90 days when I came back?

What was the Non Immigrant O visa issued for?  Can make a difference.  It can also make a difference in the office being used for work permit and extensions.

Not issued yet. I am planning on taking an extended break from work (3 - 6 months). In the meantime I am going on a few overseas trips and my current extension will expire in that time. So I though that while I was overseas I would apply for a Non-O (Marriage), come back on that and then when I started work again get an extension based on work.

Believe some offices will accept marriage type but others will want an actual B visa to issue the work permit.  Some here are current and can advise if you report the office that you will be using.

You can get a work permit and work with a non-o visa or extension of stay based upon marriage.

The majority of work permit offices with issue the work permit and I am sure that office will do it. Just attach your marriage certificate and perhaps a Kor Ror 2 marriage registry to prove you are still married to the application.

So if I understand correctly, I can enter the country on Non-O, get a work permit and then extend my stay using WP and company documents as I used to do before.

Yes but if you can meet the financial requirements it would be best to apply for an extension of stay based marriage. If your job ended your extension would not end.

You can use your income form working to meet the 40k baht income requirement for the extension based upon marriage application.

I'm glad you bring up the 40k per month. I thought (incorrectly?) that that was foreign income only. I will make about 110k a month so you're saying if I use my contract/tax receipts etc. from work done IN Thailand that will qualify me for the marriage extension. Joyous news indeed. ^_^

You can certainly use your income from working to apply for the extension. There is no requirement for it to be foreign income and the police order mentions tax payment receipts.

Yes you do not need a non B visa to work in Thailand.

It is perfectly legal for you to work with a Non 0 visa and a marriage extension.

Just because you are staying here based on being narried to a Thai, that does not stop you from  working in Thailand if you can find a job and the company that wants you is willing to do the paperwork to get you a work permit.

The two things are not mutally contradixtory.

The thing you can not do however is to be "retired" and have a so-called "retifement visa" and work.

But remember that in order to show proof of income from a Thai salary, you need a tax form. So you will have to have been working for a few months in order to apply for extension of stay.  As for your other questions, yes you will need a re-entry permit if you leave the country after you  apply for extension of stay. The multiple entry visa will be voided out at that point.

You don't need to apply for the extension of stay. You could legally work on the non o multiple entry visa and a valid work permit.  You would just have to leave the country every 90 days rather than doing a 90 day report.

In BKk there isn't any difference applying for reason based on work or marriage but up here in CM they tell us every year to just apply based on work as he marriage is more hassle.
