Does anyone know how I apply for a non O visa I am only here 6 most a year to spend time with my kids.

 

At the Thai embassy in california they always ask if we are still married.

I had records of the money I sent for my kids for the past 3 years but all were stolen.

 

Yes the kids are my kids. Thai-American.

Since I work 6 months in America they do not spend the full year with me.

Right now I'm on a tourist visa that I extend and have to do the fun boarder run.

Any help is greatly appreciated.

Are you still married?

There is no requirement or you to live with your wife.

If she is willing to help you, you can extend your stay by reason of marriage to a Thai for a year at at time.

it will cost you as there are financial requirements.

You will need oroof of marriage to her, and 400K Baht OR proof of 40K baht monthly income.

if you are outside Thailand working you will need a exit re-entry visa for the period you are not in Thailand.

The only requirement you MUST meet is to be in Thailand once a year at renewal time to renew your marrige visa/extension.

Your marriage visa,extension will be good for one year, and must be renewed annually.

Your multiple entry exit re-entry permit will be good for the same time if you get your marriage visa/extension at the same time.

So you can spend 6 or 7 months outside of Thailand, enter Thailand again with your still current multiple exit re-entry permit.

In that time renew your one year marriage visa/extension and the get a new multiple exit re-entry permit and you have the financial requirements.

Now you can exit Thailand and work if you want to in your home country to earn money.

You can keep doing this each year as long as you and your Thai wife are willing to go through the process.

It is a bit of a hassle, but it can be done by any reasonably intelligent and aware person.

So you can work outside Thailand and also have a wife in Thailand at the same time.

Before getting divorced you could get a multiple entry non-o visa that would allow unlimited 90 day entries for a year from the date issue.

You can get a 60 day extension at immigration to visit your wife or children for any type of entry.

For 12 month extension from Immigration in Thailand.

 

2.18 In the case of being a family member of a Thai national (applicable only to parents, spouse, children, adopted children, or spouse’s children): 

Each permission shall be granted for no more than one year. 

 

(1) The alien must have been granted a non-immigrant visa (NON-IM). 

(2) The alien must have proof of relationship. 

(3) In the case of spouse, the relationship must be de jure and de facto: or 

(4) In the case of children, adopted children, or spouse's children, said children, adopted children, or spouse's children must not be married, must live with the alien as part of the family, and must not be over 20 years of age except in case of the person hereof is of illness or disability and cannot live without support of father or mother: or

(5) In the case of parents, the father or mother must maintain an average annual income of no less than Baht 40,000 per month throughout the year or must have deposited funds of no less than Baht 400,000 to cover expenses for one year.

Please make sure in the divorce agreement you have joint custody of your kids with equal access.
