It can go too far but, for the most part, the advice given (especially about how to dress) was spot on. Being softly spoken and apologetic is also good advice. The reality is that you are asking the immigration officials to help you, and your approach should recognize that reality, without appearing to offer false abasement.

In a literal sense, no he doesn't 'need' to, he can attempt the other courses of action recommended in this thread, with lawyers. Others have been successful. 

 

In an ethical sense - well the law changed while he was on overstay. At the point that he broke the law the only penalty was the 20k fine. Also a visa infraction is really just a minor administrative issue, 'broke the law' is a bit of hyperbole. There are no prison sentences for visa overstay, only deportation and a fine. Those are punishment enough. It's a victimless crime. 

 

What you're recommending would have a victim, his child.

My advice to your friend is to go to the airport, pay the 20,000 baht overstay fine, accept the blacklisting, get on a plane out of the country, then go to Cambodia and live there, where your GF and child can easily visit you from Thailand.

should have got legal while his wife was expecting. "a minor administrative issue" doesn't get you banned for 10 years <removed>

Absolute rubbish, there are over 1000 people in the UK with the name John Smith, hence according to you if one gets blocked they all get blocked!!!

My brother works in UK immigration and according to him all passports presented at any foreign immigration are scanned and logged by number and name only. If you presented a second or new passport then there would be no visible relationship to any previously presented passport.

I believe almost all counties also record date of birth. We know Thailand attempts to link current and previous passports for individuals within its immigration system. This is known to be successful at least some of the time. In many countries, there are attempts to collect biometric data to supplement and validate information on the passport's electronic chip but, photos on entry and exit notwithstanding, I do not think Thailand yet does this much.
