Harsher labour law penalties hit Phuket employers, foreigners

 

PHUKET: The Chief of the Phuket Employment Office (PEO) has cautioned foreigners and employers to be aware of a raft of new penalties for breaches of labour law introduced on Friday.

 

The warning follows the newly issued “Emergency Decree” on “Management Immigrant Work” dated June 17, which came into effect on Friday (June 23). (See original document in Thai here.)

 

“To all employers and foreign employees, please be careful, because some of these new penalties are very harsh,” PEO Chief Pitool Dumsakorn told The Phuket News today (June 27).

So if your 'boss' tells you to do something that's not quite covered by your work permit you can end up with a large fine and potentially be sent to prison or you will be fired for not doing your job.

 

Better to avoid Thailand when looking for a place to work and live.

Thailand isn't the place to work as a foreigner, that is for sure, they are aways trying to catch you out, and could at any time arrest you, fine you, and then deport you. It isn't a place to live either, continually having to do nothing, in fear of being arrested for not having a work permit for say gardening or even painting the house or indeed any activity that could be regarded as work in the eye of the authorities.

Lets keep this in perspective...  Thailands laws are often daft and somewhat draconian especially when taken directly at face value. However, has anyone really been arrested for gardening or painting the house and then deported? or is this another one of those barstool myths ?

 

If  locals or farangs cheat and break the immigration/employment laws, they looked for trouble at the first place.

My best guess is that saying was invented at Walking Street in Pattaya, where all the clever guys move.

Setting up higher fines for when they start actually fining and deporting foreigners who do jobs they should be employing Thai staff to do but do themselves

They will not arrest you for working at or in your own home if you are not running a business from it

Doing jobs at a business premises are a different matter altogether, you must use Thai staff for all work reserved for Thais or face the consequences

An interesting point is that many farangs set up a company in order to purchase land and/or a house with the registered premises of that company being the house in question. In theory this is then a business premises!

Are you referring to foreigners in Thailand or foreigners in your home country?

But they do not run a active business from those premises or need or have any employees usually

Just a way of getting around the property laws promoted by law firms which is not really legal

Nominee thai share holders with a foreigner holding all the voting rights from what i have been told

Personally i do not use one, all our property is in my Thai wife's name and she owns it legally and we will have no hassles in the future

You probably don't know that you can be subject to breaking the law for fixing your car or even your computer. Maybe if you did you would toot a different tune.

And how many people do you know who have been prosecuted/fined/jailed/deported for fixing their own car or computer?

You obviously are a bar stool lawyer who knows nothing about the law. Just cos it isn't being enforced now doesn't mean it doesn't exist.
