  1. The argument is over the Texas law being invoked in the lawsuit. The lawsuit does not claim Trump was defamed by the network, said Geoffrey R. Stone, a First Amendment scholar and law professor at the University of Chicago, who reviewed the complaint. Instead, the suit attempts a novel use of a Texas statute that is meant to prevent advertisers from misleading the public about a product being sold — the Texas Deceptive Trade Practices Consumer Protection Act. Stone called it a "misapplication" of the law. "That statute is about sales — a salesperson can be held liable for stating that a product has certain positive effects when he knows it doesn't," Stone said. "But CBS is not engaged in advertising here." https://www.cbsnews.com/news/trump-sues-cbs-news-60-minutes-interview/

  3. Whatever the merits of the case under Texas law, this is clearly a case of venue shopping: Matthew Joseph Kacsmaryk is an American lawyer who serves as a United States district judge in the United States District Court for the Northern District of Texas. He was nominated to the position by President Donald Trump in 2017 and sworn in for the position in 2019. Conservative groups and Attorneys General in Texas tend to file cases in Kacsmaryk's jurisdiction so that he is likely to hear those cases, as he reliably rules against Democratic policies and for Republican policies. In 2023, he presided over a lawsuit regarding the Food and Drug Administration (FDA)'s approval of abortion medication mifepristone in 2000, and had issued a preliminary ruling suspending the approval of the drug, marking the first time a court tried to invalidate the approval of a drug over the FDA's objection. His injunction was lifted unanimously by the Supreme Court of the United States on June 13, 2024, restoring access to mifepristone under current FDA regulations. https://en.wikipedia.org/wiki/Matthew_Kacsmaryk ******************* The US District Court in Northern Texas currently assigns cases in a way that any case filed in its Amarillo Division is automatically assigned to Judge Matthew Kacsmaryk, a Trump appointee. https://edition.cnn.com/2024/11/01/media/trump-cbs-lawsuit-harris-60-minutes-interview/index.html
  4. Yes no worries -- if your topics didn't populate the sidebar, I would know you exist.
  5. As long as they don't restrict the number of new topics one can start per day or per week, you'll be OK.
  6. Maybe by saying the "sinistrality of our policyholders" it was a spell-checker gone awry and they actually meant 'sinister intentions of our policy holders' as in another recent topic where the policy document had to be modified due to instances of fraud.
  7. Not only do premiums go up, but we have it on authority that -- "Those insured should also be self insured as a "claim denied" is likely and common." https://aseannow.com/topic/1299265-when-does-it-become-time-to-put-money-aside-in-a-separate-account-and-self-insure/?do=findComment&comment=18172290
  8. If candidate A wins their states by very narrow vote margin, but candidate B wins their states by very large margin, then it is easy outcome that candidate A wins the electoral college vote but candidate B wins the popular vote.
  9. https://aseannow.com/topic/1286793-wrlife-claim-filed-take-2/ WrLife Claim filed Take 2 Posted February 17, 2023 I reported on this forum that I had received hip replacement surgery following a fall JAN 2022 and that the surgery was paid for in full by WrLife. There then followed several posts by other AN Members to wit: Oh Yeah? But that was a hip fracture following an accident -- well whatabout how WrLife would cover you when there was an illness or possible pre-existing condition denial, HUH? OK. I regularly see a urologist for PSA check and DRE. In DEC 2022 the urologist gave me a written certificate report including: Inguinal Hernia I contacted WrLife and claim processor AIS. They requested the current report from the urologist and previous reports from the same urologist that showed no indication of hernia including a recent KUB ultrasound (Kidney-Urethra-Bladder). They also requested the insurance certificate of coverage from my previous insurer CIGNA Global. Open inguinal surgery performed JAN 2023. Paid for in full by WrLife.
  10. It's been close to 3 years that I signed on with WrLife and a few months after that I reported here a big claim was paid. For that I have become the prime target of -- Oh Yeah -- so who's the underwriter? What is your country jurisdiction? where are you going to sue WHEN your claim is denied? Their business plan is unsustainable What is their A.M.Best rating So you bought a pig in a poke ??
  11. Nevis is a nice place to visit. So it would have made better sense to register the company in Burkina Faso: DO NOT TRAVEL to Burkina Faso due to terrorism, crime, and kidnapping. https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories/burkina-faso-travel-advisory.html
  12. I think you are misreading the document: Cardiovascular is not on the list of degenerative diseases. Specific diseases: Hypertension & Cardiovascular Disease, -- Always 6 months waiting period in any case
  13. The 'cover' as expressed in the recent WrL policy document for degenerative illnesses will be almost exclusively outpatient cover or what in US is considered long term care or LTC. If you only have inpatient cover, it is practically then moot point and inpatient care only when medically necessary. And note from this CIGNA Global (Thailand) policy if you have 150 million baht inpatient cover you will only have 2.5 million outpatient cover.
  14. Since I have no direct experience in the industry, I try to only post directly from entities that are -- not winging it like the above. A major int'l broker says that a protected cell captive is particularly suited to: Acting as a fronting structure to access the reinsurance markets.
  15. The photo below was in a NY Times pictures of Phil Lesh article. I went to a 1967 Grateful Dead show at the CafeAuGoGo. I was a kid from NJ pre-driver's license. I took the train and the PATH tube into NYC to the show. The layout of the club was long and narrow with the stage in the middle. In the middle of a set, my timing was I had to leave to catch the last train home. I had to walk within a meter of Jerry Garcia on the way out and he gave me a look like my walking out was as editorial opinion on his show. But it was otherwise fun mostly playing stuff off their first album.
  16. Much thanks for being spokesperson for the industry.
  17. Only time will tell, huh? ... or as the the long beleaguered Chicago Cubs fans used to say: Wait 'Til Next Year
  18. The prime determinant is: Did you have chicken pox as a child? Shingles is caused by the varicella-zoster virus — the same virus that causes chickenpox. After you've had chickenpox, the virus stays in your body for the rest of your life. Years later, the virus may reactivate as shingles. https://www.mayoclinic.org/diseases-conditions/shingles/symptoms-causes/syc-20353054
  19. And it's clear who the insurer is "Insurer: insurance company or captive or compartment of captive or protected cell of captive" https://www.vermontcaptive.com/captive/
  20. Old Age? As above that is S-O-O-O funny. But as long as we're in comdey mode, how about this (with apologies to The Treasure of the Sierra Madre, 1948): Underwriter? We ain't got no underwriter! We don't need no underwriter. I don't have to show you any stinkin' underwriter!
  21. It depends upon how much outpatient insurance you have, if any.
  22. From the Billy Wilder movie One, Two, Three in 1960's occupied Berlin (James Cagney as C.R. MacNamara -- Schlemmer his assistant) C.R. MacNamara: Just between us, Schlemmer, what did you do during the war? Schlemmer: I was in der Untergrund: the underground. C.R. MacNamara: Resistance fighter? Schlemmer: No, motorman. In the underground, you know, the subway.
  23. I am sure a lot of Hitler people felt the same way...until they didn't. I don't think a lot of Hitler people wanted Harris to win.
  24. #6 worldwide non-US captive domicile
  25. In a recorded video, the child asked the Republican candidate about his favorite farm animal. “I’ll tell you what I love, I love cows, but if we go with Kamala, you won’t have any cows anymore,” the former president responded to the child’s question. “I don’t want to ruin this kid’s day.” He then called Harris a “radical left lunatic.”
