Slovak citizen is living and having business in Thailand – he has a business visa (being two years as a managing Director and one of owners of a foreign company in Thailand, having BOI sponsorshiap); he and his girlfriend are expecting baby and therefore they would like to live togehter in Bangkok. His girlfriend is a Hungarian. In the near future they do not plan a wedding, but she would like to deliver the baby in Bangkok and therefore she has been already in contact with a local doctor and has already completed an initial examination. Do you think that there is any possibility for her to become a visa B-0 for the purpose of a family reunion? What documents would be necessary to be presented for that? Or do you advice any other way how to get any long-term visa for her?

No. Unless you get married there is no long term visa/extension of stay available as a family member.

As others have stated, the visa would need to be independent of your relationship. Apart from a Non B visa and extension on the basis of employment, a student visa and extension might be possible. However, if it is at university, she would need to qualify and be a genuine student. Finally, the Privileged Access visa available with the Thailand Elite program (while expensive) is an easy way to stay.

The cheapest costs 500K Baht. That gives a multiple entry visa valid for 5 years. Each time you enter you're granted a 1 year permit to stay.

One question more: what happens if she delivers the child in Thailand? The child will become the visa because of father working and living there (reunion) and the mother? Does not than become the visa because of child (reunion)?

The child will be able to get an extension based upon their parent's extension. The mother would not be able to get a visa or extension based upon their child's extension.

The baby requires a visa by law, but some parents don’t bother because babies can’t be fined or banned for overstay.

 

First they should get the baby a passport so they can leave the country or apply for a visa. 

 

If the parents want to keep the baby ‘legal’ they can apply for a visa/extension of stay for the baby. The baby will effectively ‘piggyback ‘ the fathers existing permit to stay.

 

Having the baby in Thailand doesn’t help the mother to get/qualify for a long term permit to stay.

For the mother, there is the non-O visa to travel to Thailand for the purpose of visiting her child. Some consulates may issue this visa only for a single entry and some may grant it only if the child being visited is of Thai nationality.

 

The best place to apply for this visa will probably be the consular section of the Thai embassy in the mother's country of permanent residence.

OK, thus the only possibility for the mother is:

a/ to be employed in Thailand - in his copany it is not so easy, because they are under BOI sponsorship, therefore there must be 3 Thai citizens vs. one foreigher employed

b/ to start study on any Thai university - then she receives 90 days visa which would be prolonged in case of her study goes further. Do you have any experience with possibilities in such study?

She doesn't need to study at a university. She can sign up at a language school to learn Thai, and the school will sponsor a visa/extension of stay. She would need to attend the school a minimum number of hours per week. I believe it's at least 2 hrs/day for 4 days/week. The sponsoring school would confirm.

 

She would need to get a non-immigrant visa 'ED", which she would have to apply for at a embassy/consulate outside of Thailand. That would give 90 days on entry. She can then apply for extensions of stay every 90 days. Total stay is 1 year.

 

If she gets a place at university, she could get 1 year extensions of stay all the time she was enrolled at the university.
