Hello I'm guessing this has probably been asked before but here we go.. My wife and I got married in Thailand a year ago. We got all the paperwork part in bkk as well as a lovely traditional wedding in Khob kaen. My question is would it be possible to get her a uk settlement visa we both in our thirties and I meet double the financial requirements and she speaks good English . Any opinions would be greatly appreciated thank you...

Yes it would. Although the costs of a Settlement visa are pretty expensive they are easier to get, imho, than a visit visa as your wife doesn't need a reason to return to Thailand.

 

She will need an English language test, a TB test and you need to show that you have the finances to pay for it all.

 

Obviously there is more to it than that but they are the fundamentals. Her visa will last for 33 months. The next visa is Further Leave to Remain (FLR) which lasts for 30 months which she will apply for in the UK when she will need the A2 English language test. After living here for five years she will need to apply for Indefinite Leave to Remain (ILR). She will need the B1 language test and to pass the Life in the UK test.

 

If her English is that good, get her to take the B1 test for the first visa so that she, hopefully, won't need to take another language test.

 

You will need to pay the NHS surcharge for the first two visas and expect the whole thing to cost north of £10K over the five years. The visas seem to go up by around 20% each year and the NHS surcharge has just doubled to £400 a year. For the Settlement visa it will be £1200 and FLR will be £1000. Your wife will be allowed to work when she comes here.

No it hasn't, it's still £200 per year or part year over 6 months, so for a settlement visa the Immigration Health Surcharge is still £600 per application.

The applicant needs to satisfy the ECO of three criteria, these being.

 

1. That the relationship/marriage is genuine and subsisting.

2. Financials.

3. Accommodation arrangements in UK.

 

In addition the applicant will need a valid TB certificate and an English language test certificate or Degree with UK NARIC statement.

Oops. You are right. It hasn’t been implemented yet. Coming later this year though.
