Good afternoon all,

 

Before I start, I just wanted to say thanks to all who post useful information on this forum.  It has been a major help and invaluable in completing the numerous applications over the past few years, with the often vague requirements and criteria on the forms.

 

My wife is just about to apply for her ILR on the 5 year route (SET M) and I was nervous I have understood correctly a few things on her application:

 

  • We have one child dependant, but he is a UK citizen and not applying.  Am I correct in thinking the required income threshold would then be £18,600, not £22,400?  On her FLR application I put down £22,400, but looking at the guidance again I think this may have been a mistake and too high.
  • She works part time as a relief cleaner.  As my salary is enough to meet the financial reqs in itself, I wasnt going to include her income on the form as she only receives electronic payslips and the income is irregular, so it would be much simpler to ignore it.  I assume this wouldnt be an issue and make the process more straight forward?
  • She has an accredited Trinity College CEFR B1.1 in speaking and listening that has now expired.  It was used in her previous FLR, so I assume this is still valid for purposes of her ILR?

 

Thank you in advance for any replies, I think from reading other posts my above assumptions are correct, but the costs and formality of it all is leading to some paranoia on my part that the application may get rejected.

You are correct that as s/he is a British citizen then your child does not need to be included in the application nor the financial requirement. However, as you put £22,400 last time then I'd either put the same again or include a brief note of why it's different this time.

You, or rather she, only need to provide evidence that the financial requirement is met. So if your income alone covers this then there is no need to mention her income in this section.

Yes, provided the pass has been used in a previous successful application it can be used again, even if the actual certificate has expired. So not only can she use it for her ILR application, she can use it for her British citizenship application as well; assuming she wishes to naturalise as British, ofcourse.

Yes she will be applying for naturalisation shortly if all goes well...
