Defamation is the issuance of a statement about another person or business which causes that person to suffer harm. It does not have to be false to be defamatory. Libel is when the defamatory statement is published either in a drawing, painting, cinematography, film, picture or letters made visible by any means, or any other recording instruments, recording picture or letters, or by broadcasting or spreading picture, or by propagation by any other means. Defamation is both a civil and criminal charge in Thailand.

Wait. You can't be possibly that clueless.

LOL> You really think I own a pizza restaurant.

I have had experience with a defamation case, both civil and criminal, unrelated to pizza restaurants, so I was merely offering some information on how such cases proceed.

What about firms like Lazada. On every item you buy there are reviews from previous buyers. Some give 1 star bad reviews. Are they all prosecuted?

I think they are anonymous reviews and Lazada would be the only entity liable for prosecution. I never rate anything on Lazada.

Tell the truth=go to jail.

Normally the police do not care about farang on farang squabbling.  Interested how this plays out, but I'll guess someone will end up making a donation to the coffers.

Good help isn't free.

Has the guy been sent to jail ?

Threatened with jail, I was playing journalist and embellishing.

Perhaps if he is sent the jail he can do review from jail.

Example:

Oh, the fish head gruel was very good today and somchai didn't rape me too much last night.

The police have nothing to do with this. They have 90 days to start a criminal case and a year for a civil case.

I was not aware of this.

It's easy here... just hire a lawyer and start the criminal action directly with the court.

So the internet should be a place where only posting positive things like images of puppies or cats is permitted? Nobody can voice their opinion on a meal they have just eaten?? If you run a business such as a restaurant, you should expect and deal with differing opinions and reactions. It is par for the course, especially if you serve up a shoddy or subpar service

You are naive if you believe that only "customers" write reviews. So do their competitors, people wishing to gain financially et al. It is not as simple or as innocent as it sounds.

It should be like employees? Praise in public, criticise in private.

The threat came from the restaurant owner , there is quite a big difference between someone threatening to take legal action and actually  being sent to jail .

Can someone PM me the name of restaurant ? I want to be sure to boycott this d#ckhead. Thank you.

Same here. Don’t want to support a business that would take this sort of approach with their customers.

Yes, it's my restaurant. Would you like all the details of the legal action too?

Somehow I doubt it if the rest of the thread is to be believed.

Hi there,

A member kindly provided me a CLUE about what the offending review might have been. I'm not sure so take this with a groan of salt.

Anyway, based on my reading of what MIGHT be the offending review, I can better understand why the owner would be pissed off. I'm not condoning or approving any lawsuits over reviews of course, but the thing that struck me as crossing a line was getting into posting unfavorable impressions about the personality/character of the owner in a personal way.

That is something I would hope people would avoid in restaurant reviews. It's one thing saying the service was really slow but to get personal and insulting about a specific person whose identity is easily known is another. I would certainly avoid doing that online and it's something that I would consider a post that should be removed and reported if it happens on this forum (which, BTW, it has).

Just my two cents and quite possibly barking up the wrong tree because I don't have confirmation that what I'm commenting on was the thing.

Cheers

Is that a threat?

No, not at all. It was meant as a joke reference to your hit and run restaurant review thread which I assume must have some negative reviews on it.

I know. I'd rather not think about it!

Like I said above I strongly discourage people from making insulting personal comments about staff or owners at restaurants about people that can be specifically identified!

Nothing in your several posts was indicating you were joking. And then in a following post you said "nothing is forcing someone to write a bad review on the internet" which is baffling coming from someone born in a country with freedom of speech. Would have made sense coming from that idiotic restaurant owner.
