wife is thai

i am a uk & irish passport holder

our 6 year old daughter who was born here in belfast has also a british & irish passport

11 years now she has been resident in belfast ( northern ireland - uk ) yes confusing isnt it....... lol

wife has ILR in UK

wife is " not " working at present. 

we are still legally married

 

can she apply or get irish naturalisation ?

Check citizensinformation.ie, your wife could possibly be entitled to Irish citizenship based on marriage but there would have to be a min residence period in the state of Ireland for either 3 or 5 years.

thanks but as i have allready stated..she has been a resident 12 years now , last time she was out of country was 6 years ago.

Personally I do not know enough about it but for such an important matter would it not be best to write to someone at the department of foreign affairs and trade stating your situation and questions, I'm sure they would clarify.

not that she has been resident in the Republic!

 

However, as you are an Irish citizen then her residency anywhere on the island of Ireland counts; from Become an Irish citizen by naturalisation

She is also, of course, eligible to apply for British citizenship, and has been for the last 8 years! Why the rush now and why Irish rather than British? Brexit?

 

No reason why she can't apply for both.

thankyou,  she hasnt applied for uk residecy because she came to uk under eea rules....also she did not know she could apply, no one ever told us, also we fought a hard battled with home office 6 yrears ago to bring her children to UK even though she and i were fully legal we fought them in belfast crown court and after 2 times they were going to appeal again !!!  but in end we won and got kids here...uk & home office are a bloody discrace.

 

islamic migrants with 10 kids & ex ISIS combatants get first class passage with all the trimmings !!!

She could have applied for permanent residence any time after living in the UK for five years. To be totally accurate, she doesn't have to apply as she would have got it automatically after living here for 5 years! Once she has held PR for 12 months she can apply for British citizenship, but would need to actually apply so she has the documentation. She also needs to pass the language test and LitUK test.

 

The rules did change so that EEA nationals with two or more nationalities cannot use their nationality of one member state for their non EEA national family  to travel to or reside in another memer state of which they are also a national. But as your wife moved to the UK before this change, she still comes under the old rules.

 

This may be why you had difficulties with her children; did they apply under the EEA rules or the UK ones?
