Son 'high on meth' allegedly killed by father in self defence

A 61-year-old father has been arrested in Phayao after he allegedly shot dead his unemployed son who was reportedly high on methamphetamine, set fire to the house and tried to attack his parents with a knife.

 

Sathien Arsa waited for police with his homemade rifle in his hand at 5pm after he allegedly killed his son, Porn Arsa, 38, at his house in Moo 5 village in Tambon Chiang Muan in Chiang Muan district.

 

Sathien, who now faces a murder charge, told police that his son was high on meth and set fire to their house but neighbours helped put out the fire.

 

Sathien said his son then tried to attack him and his wife with a knife so he had to shoot him to defend himself.

 

Sathien said his son was unemployed after he got a bachelor's degree. Sathien said his son lived with his wife and eight-year-old daughter but Porn often quarrelled with his wife, prompting her to leave him earlier.

Someone who has an 8-year-old daughter and a degree is hardly a child.

Just realize that you will be arrested if you use a firearm in self-defense.  It seems you're expected to simply submit to being attacked and accept death or serious injury.  Defend yourself - you're charged with murder. 
Scary that you have no right to defend yourself. It may be different for the wealthy, probably is.  Normal citizens - jail for you!  The country desperately needs a Castle Doctrine, but that ain't gonna happen.

You are viewing this as if it were a Western justice system. It is not.

 

The arrest and murder charge are mandated by the system but in no way mean the case will automatically proceed to the Public Prosecutor. They do mean that negotiations will begin. Remember police work in Thailand is pay for play and the system is set up to facilitate that.

Very similar to Canada with some winning jury trials and other not.

I don't get what it means when you said, "Remember police work in Thailand is pay for play and the system is set up to facilitate that."

Please elaborate on that if you can.

I imagine in this case the father is charged with murder of his son but the due process of the law will find him not guilty of the crime as stated, so he would be set free. Is that how the law works in Thailand? Whether you are defending yourself is immaterial until the law says you are not guilty. Hope I got it right.

This is where your view of the Thai judicial system diverges from mine.

 

Whether he is charged in Thailand and the crime he is charged with are decided by the police in Thailand.

The police here commonly accept money to lessen or drop charges.

The police here commonly pressure victims to accept financial deals in lieu of prosecution of the perpetrators.

The "due process of the law" here is overwhelmingly based on the status of the people involved (as important people can get police moved or censured) and the deal they can strike with the police. It is far more similar to "village justice" than anything you could call "due process of the law" in the West.

I guess I lived for too long in Britain where everything is decided by the English laws. The strange English Laws where if you occupied a land long enough and the owner didn't complain or go to court to evict you , you could finally be allowed to occupy the land or gain the right to do so.

Now that you explain quite clearly Thai judicial system I get a good picture of what is going on. I shouldn't get involved in a country with laws like that you know. Shitty is the word for it. Perhaps you may agree.......ha, ha, ha,
