Hi All,

 

An Aussie man & Thai wife want to divorce, we were married in Bang Rak Thailand in 2013 and separated more than 1 year ago. We both live (separately) in Australia and she is also now an Aussie citizen.

Can we divorce in an Australian court? A copy of the marriage must be given to the court to do this, but the marriage certificate is a Thai document, obviously written in Thai.

Will the Australian courts recognise a marriage performed in another country and be able to issue a divorce?

 

Has anyone here divorced in the same circumstances as this in Australia?

But it can be translated into English and registered with MFA in Thailand, thus becoming a legal document in English.  Do not know if this is required in Oz or not but it is the normal process for an official translation of a Thai document for legal use outside Thailand.

Divorce in Australia is NOT the financial settlement. It is only the formal end of the unity of the marriage.

Agreed. If yer missus is willing and you both agree to whatever you've acquired being split amicably then it's a 20 minute process at the Amphur in Thailand.

She will have a big problem - not after reporting every 90 days like a criminal but after renewing the yearly "marriage permission to spend your own <deleted> money"

 

She will be informed of a brand new rule which is nowhere published, fresh as somtum. Requested to provide 47 pictures of peeing together in happiness with you.

 

Then if she can provide proof signed by blood of earning 4x of the national median income, mere $240,000... she may be permitted to have the rights of a vermin.

 

Oh wait I'm wrong, she is a Thai in civilised country.
