How is the Senate (about half of whom are Democrats) not doing their constitutional duty?

The question is whether he'll ever face consequences for that. 

He's avoided that all his life so probably not.

The Dems accuse of that, but others do not believe it happened. Crucially, those on the side of not believing it happened are the majority in the senate.

While it's a distraction from the work the government should be doing, it begs the question that if the house can waste so much time on something that is most like to fail in the senate, what are they supposed to actually do that is it is necessary to pay them so much to not do.
