Can I get legal custody of my daughter. She's 12. And wants to be with me?

If you can pay your ex to sign her to you, then yes. 

If you can't persuade her to sign, then it will be very difficult, if not impossible.

Where you married at the time of birth? If yes you already have shared legal parental rights with the mother.

Yes married before birth. But wondering if we were to divorce in court and daughter chooses to be with me, can I be awarded soul custody, baring in mind that I'm not Thai, and on a Non B visa.

That's most unusual that a custody case would reach a court...............

That's usually a mediation case.

That you are a foreigner is of no concern. But sole custody is rare, judges like to award chaired custody. However if the mother agrees and you can give a valid reason for sole custody it should not be a problem.
