My wife is currently on her 2 year extension of leave visa which runs out in july.

We have 1 child together born here in the uk.

she originally arrived on a fiancee visa back in 2005.

He passport runs out in august and my understanding is that we need to go to londons thai embassy for a new passport.

i have just had a look at the SET(M) form and it mentions the ESOL or Life In The UK Test.

My wife has done neither, she has however done a CLAIT computer course but at the time we chose not to do the ESOL.

He english is very good, and the ESOL can be done (and is planned) but obviously not before july.

Could somebody give me a bit of guidance on how get the correct visa and requirements within our time constraints.

oh and has this requirement just come in from april ?

Yes, the requirement to demonstrate knowledge of life in the UK was implemented in relation to applications for ILR earlier this month. If your wife is not going to either sit an ESOL with Citizenship course, or take the Life in the UK test, before the time comes to make the application to the Home Office, there is no point applying for indefinite leave to remain as it will be refused. Your wife should, therefore, make an application for an extension of her current visa and, all things being equal, she will get another two years during which time she can obtain her citizenship qualification. The cost of this application to the Home Office will be £395.00.

The situation is further complicated in that your wife's passport will expire at the same time as she should be making the application to the Home Office. If she makes an application to the Thai embassy in London now for a new passport, it is possible that she might have it by mid-June, and in time to apply to the Home Office. However, she will need to attend the embassy in person which is a bit of a hike when you live in Warrington (I know it, too, as my wife and I have had to make the same journey from Liverpool). If all else fails, your wife should make the application to the Home Office before either her current extension or passport expires. It does not matter so much that her passport might finish whilst with the Home Office; the important thing is to make the application for the extension before the current one expires.

Getting a new Thai passport is straightforward at the Royal thai Embassy in London, make an appointment and pitch up with her old passport and ID card. Allow 6 weeks for processing.

As your wife is good at English she can simply study the syllabus from the book, book a test at your local test centre and sit the test. See Life in UK Test . You can buy the book at WH Smith or on line from that web site or Amazon.co.uk.

Then with that provide what it suggests on the SET(M) application form in the notes.

Yes the LIUKT requirement was introduced this month.

how soon before her current visa expires can we apply for the new one.

i remember reading that you should not apply more than 1 month before.

is that still the case now ??

going to get the extension as we planned the ESOL as i mentioned and thats ideal.

she is eligable for normal college costs soon too.

cool,

we can get her extension sorted this month then the passport in june / july.

shes relieved about the test too. all her friends are tellin her its difficult..... but they do love to exadurate.
