converting to marriage visa in Thailand. Immigration lady gives as <deleted>, and scares us

Let me start with our story for context. Me and my then fiance been together many years in USA and decided to get married and settle here in TH.  Originally i supposed to come to thailand in march 2020 but because of covid i was stuck in Poland  and came later  in december that year. I was stuck that long  in my country because i wasn't yet married to thai citizen and no other visas were available. Plan was to get married in thailand and convert to 1 year marriage based visa.  Came in December married in January. During that time i extended my TR visa for another 30 days and apply for 60 days extensions based on marriage to season money on my thai bank account. OK now seems like i have everything i need . We  applyed yesterday , Immigration Lady took our application but kept saying that we did it wrong and might not get approved . According to her we should  get married in my home country (wasn't possible she never been in my country and would need visa + covid restrictions). She also said we might not be approved because we don't have any kids and i am young  (me M34 her F38) And our application has to go to chang mai then to bangkok embassy or something?.  So my question is.... is she right? i dont understand why we would not qualify. Isn't getting married in thailand like best thing to do? what's about the nonsens with embassies , being young or having no kids ? what's my options now?

 all i got is blue recipe with stamp saying decision will be made on may 5th. I have to be there on that day. There is nothing in my passport. By the way my visa expires on May 7.

I was thinking of the extension application but you applied for a 90 day non-o visa entry based upon marriage.

You did not have to wait for the 400k baht to be in the bank for 2 months for the visa application.

It will be approved by Division 5 as wrote before unless you are living in another part of the country.

It should be approved by the 5th.

After the visa issued you will be able to apply for the one year extension during the last 30 days of the 90 days.

i already used up 30 day TR extension and 60 day marriage extension. It is only 60 days when you already in Thailand instead 90 day when applied from outside. So that was surprise for me and  that's why i had to do 2 extensions to season money. And this Post is about 1 year proper non O visa i am Appling now. Sorry if i wasn't clear

You have to have a non-o visa to apply for the one year extension and that is what you applied for using a TM86 change of visa status form and paid the 2000 baht fee.

You only needed the money in the bank on the day you applied for the non-o visa.

You did not really need to apply for the 60 day extension if you still 15 days remaining on your 30 day extension you could of applied for the non-o visa then.

Most offices start 90 days from the visa on the day you applied for it.

Hello Joe!

What is the situation when renewing a one year extension based on marriage? Do you need 2 months seasoning the 400k or the money only needed on the same day?

You will need it to be in the bank for 2 months to apply for the extension of stay.

My post was about applying for a 90 day non-o visa entry at immigration.

I don't want any trouble with immigration people but more we think about it more messed up it gets. Every time we go there to do simple procedure first answer from their mouth is " it can't be done,  or its not possible"  I am talking about extending extendable visa for example. After a lot  of explaining and almost bringing people to mental breakdown it can be done.  They also deny existence of covid extension and claim that is our application gets rejected i have to just leave the country in the middle of covid crisis. So if this is not shameless attempt for bribe idk what is. I heard from people around here that some tea money is needed to make things easy. I am writing this because the same person giving us pointless trouble will probably be the one visiting our house so my question is... what trouble can she give us and how can we brace against it? it there a way to appeal to someone higher? i don't want my life upside down because of someone's abuse of power. Any advice??

The usual tactic is to ask for a "fee" for visiting the home. I didnt and refused to pay it, Others have. Its usually around 2000 baht. It is NOT compulsory or even legitimate to my knowledge.

It seems to me the Officer was heading toward a payment of some kind to smooth things through by constantly telling you of possible refusal etc.

Unlikely as the office staff usually only work in the office.

I've never heard of anyone being refused once the local office accepted the application form.

If you applied for a 1 year extension on the 5th April 2021, your extension will end on 5th April 2022.

Correct ! The vising Team in my case were not the staff that process the initial application.They do have additional paperwork completed at the visit and take photographs that are added to the application.

Has anyone asked you for witnesses ?

The next door neighbour came around for me, with her iD and house book when the immigration visited.

They only want one in Chiang Mai, so suspect the Op will  need one as well.

You need to go back and read all the posts again. He applied for a 90 day non-o visa since and did not get a under consideration stamp the would be given for a extension application.

Extension start from the end of your current permit to stay not the day you apply.

The 2000 baht fee was for a non-o visa not a one year extension of stay as I have written before.

That is why you only have a receipt for the 2000 baht and no stamp done in your passport that would be for the extension application being under consideration.

Usually on the FIRST application they ask for witnesses, in my case 2, one was the pu yai baan, the other a neighbour. Copies of ID card and blue house book and a statement has to be made and signed.

That's for a 1 year extension Charlie.

The OP entered TV and can't apply for a 1 year extension until he first obtains a Non O.

Last time I made the mistake of applying 1 month early, so got 1 month less.

to be honest i am still confused but i think i get it now.
1st 30 days  extension was 100% tourist because it says TR

2nd  60 days "visit Thai wife" thing stamp was just a extension and not "non-o starter pack"

now i am actually applying for non-o that will be only 3 months instead of one year? I actually had to show seasoned money, why wouldn't i get 1 year?

You appear confused.

 

You entered Thailand on a TV, which you cannot apply for a 1 year extension from.

You must have a Non Immigrant type Visa to apply for a 1 year extension.

 

I believe you possibly tried to apply for a 1 year extension, which is why the Immigration officer told you it was wrong. She should have given you form TM86 to complete, for you firstly to change your status from TV to Non O. The fee is 2,000 baht.

The 400K is only required to be in a Thai bank on the day you submit the application.

This application has to be approved, usually takes 14 days.

If approved you will be stamped with a Non O in your passport and granted a further stay of 90 days.

 

Within the last 30 days permission of stay from the 90 granted, you then apply for a 1 year extension.

At this pint the 400K must have been seasoned in a Thai bank for 2 months.

You complete form TM7 and the fee is 1,900 baht.

This again will have to be approved and you'll receive a 30 day 'under consideration' stamp. Once approved you'll receive the 1 year extension stamp.

You need to double check the dates. If applying for a extension based upon marriage they do a under consideration stamp that that starts from that day.

I have done 13 extensions and they all have the same month and day on them.

Because you entered on the wrong Visa type.

You must have a Non Immigrant type Visa to apply for a 1 year extension.

A Tourist Visa only allows one 30 day extension.

Being married to a Thai you can apply for one 60 day extension in addition to the 30 days on a TV entry.

Your under consideration stamp is dated the date of application.

When approved, your extension will be dated from the expiry date of your previous extension.

Last time I made the mistake of applying 1 month early, so got 1 month less.

Now that you posted pics of the stamps it appears that Chiang Mai immigration are doing it wrong.
