Hey guys, well first a big thank you because with the help and information i obtained from this board i am now back in Aus with my thai fiance after getting a 3 month tourist visa for her, we intend to stay here the entire 3 months then head back to LOS to plan our next step, the thing i am unsure of is what to do next...we want to settle in Australia permanantly and marry here aswell, do i apply for another Tourist visa and then when that is finished then apply for a Spouse visa? Or do we head back to LOS apply for the Spouse visa and stay in LOS until we get an answer.....also will the 2nd tourist visa increase chances of the Spouse visa getting granted? Well i guess any help or personal experiences would be great..just not sure which direction to head..and whats the usual waiting period on a Spouse application? 3-4 months? Thanks again guys, im sure i wouldnt have obtained the tourist visa so trouble free if i hadnt had all the info from this board backing me up.

I lodged my application for a spouse visa in Australia while my partner was still on a three month tourist visa. A bridging visa was granted when the application was lodged allowing my wife to remain until a decision was made. Some of the information required, such as the police check is easier to confirm while you are in Thailand. Did you bring the original copies of all identity papers with you?

Do you need to remain here to work pending grant of a visa?

Options are....

Get a tourist visa, marry here and apply for a spouse visa from LOS

Apply for a defacto spouse visa from LOS

Apply for a fiance visa from LOS and then marry here.

Get a tourist visa, marry here and then apply for a spouse visa and a bridging visa.

A second tourist visa will assist in showing a genuine and ongoing relationship, it will also help you collect more evidence towards the spouse visa.

If you apply from there then you will probably need a job guarantee or an Assurance of Support from a someone here to get the spouse visa.

A defacto visa has certain conditions on it regards your time together and would require substantial proof of the ongoing relationship.

A fiance visa requires you marry within 9 months and then apply for a resident visa...about $800+ more, but she can stay till a decision is reached.

The bridging visa option is also a bit more expensive and you will need to give thought to the time required for processing the visa in your plans.

She must be in the country of application for the visa to be issued.

The spouse visa can take from a couple of days to about 6 weeks...depends on how you do it.

Graham Burns has clearly set out the options available to you so there is no need to re-hash them.

If you choose to apply for a Spouse Visa as your next step, you need to convince the Embassy that your relationship is genuine and continuing. The length of time that you have been together is a factor in this but not necessarily a deciding factor. There are instances when Spouse Visas have been granted when the applicants has been with their partners for a very short time but those applications also contained other supporting evidence in the way of statutory declarations from family and friends who declared their knowledge of the strength of the relationship.

If you have all the required (and translated) papers from Thailand with you in Australia, then you could consider applying here but chances are that you won't have so it may be a much easier option to return to LOS and apply there.

If money is no object and if you don't want to be apart during the decision making process, then a finance visa may be the way to go.

Applying for a Spouse Visa in LOS will be your quickest option. Gather all your documents from Australia, stat. decs., photographs, letters etc., give attention to certifying those papers that need to be certified, write a strong covering letter to better explain any matters that you can't properly cover in the application form, go to LOS, obtain the police clearance and medical check, make an appointment at the Embassy and........

....if your application is strong enough, you can expect an answer within 24 hours.

I dont need to stay in Aus, so i can and will be travelling back to LOS with her when the Tourist Visa expires, It sounds like a Fiance Visa is best, Is she able to work here in Aus on a Fiance Visa? and the time frame to get married here in Aus is 9 months right? thanks for all the great information so far, very helpful indeed.
