Entered on TR, extended once for 30 days. Wife is Thai, want to change to Non-o based on marriage. Married in US.

1. Will certification of marriage certificate from Secretary of State in state which we were married satisfy MFA requirements to legalize?

-I didn’t realize this can’t be done in Thailand so having to mail to US.

-I am aware we have to register foreign marriage at local Amphur first.

-I do have an affidavit from US embassy confirming marriage certificate details, but translation company said they weren’t sure MFA would legalize based on that.

2. From list of required documents courtesy bangkokimmigration.com, can anyone clarify the following items:

-‘6.3 Letter from a government office, embassy or consulate, certifying that the applicant is a member of the referred family’

-‘Other Relevant Documents such as;
Rental Agreement between the Applicant and The Landlord. With a copy of ID card and House Registration of the Landlord (certified true copy by the Landlord) : Condo or House purchase agreement ; Location the house or condo map and a rental receipt Past three months.’

—I am staying with Thai family

-‘The applicant who comes to contact must show the notification of residence in accordance with Section 38 and present the accommodation notification.’

really appreciate any help!

Once your government (in the US) has done their part of the legalisation you need to get it done by the Thai embassy / consulate there. They should have details of how to get this done on their website.

After that you take it to the MFA. There are agents milling around there who can quickly and inexpensively get translations done that meet the requirements of the MFA. I'm not a fan of agents but I used one to do that after the translation from a lawyer in Bangkok wasn't acceptable to the MFA.

1. Instead of going through the legalization of your marriage certificate in the US you can do a affidavit to self certify it at the US embassy in Bangkok and then have it translated to Thai and certified by the Department of Consular Affairs  of the MFA in Bangkok.

"Oftentimes the Thai government requests the U.S. Embassy or Consulate General Chiang Mai “certify” documents listed under “services we cannot provide.” Please note the Embassy and Consulate CAN notarize an affidavit which may or may not satisfy the Thai requirement for “certification.”

2. Ignore 6.3. It will not be needed.

If staying with your Thai family you can get a statement from them that you are staying with them with signed copies of their house book and ID card attached.

They will also need to complete a TM30 report of your arrival at their residence.
