Hi

We are living in the UK most of the time but spend about 3 or 4 months in Thailand a year my wife is on a marriage visa here and that finishes April next year,we are planning to build in Thailand and move there late next year so dont want to go throught all the trouble with Ilr can we just extend with Flr for another 2 years? any help with this subject web pages etc regards Jim.....

Jim,

Your wife is not compelled to apply for ILR if she doesn't want it. She can seek to extend her stay by completing form FLR(M) and the fee is £395.00. She will still have to submit the requested evidence showing that you will have been living together, but she doesn't need to undertake either of the language/citizenship tests.

For leave to remain, there is no requirement to have spent a prescribed period of time in the UK, so one can apply at any time before the current conditions expire.
