Ferrari Joe could still face death penalty when case outcome is later reviewed by the Court of Appeal

The former police chief in the city of Nakhon Sawan Police Colonel Titisan Utthanaphon or ‘Ferrari Joe’ and six of his subordinates had the verdict of the court in Bangkok relayed to them on Wednesday last which saw six of them receive the death sentence which was immediately commuted to life in prison while one former officer received five years and four months for failure to perform his official duties, via a teleconference facility at the city’s infamous Bang Kwang Central Prison. This was followed by a statement from an official at the Office of the Attorney-General who explained to reporters that the judgement, in this case, is not yet finalised as even if the defendants do not appeal the verdict, it is still likely to be reviewed by the Court of Appeal as a matter of procedure.

The Ferrari Joe case involving the torture and murder of a 24-year-old drug suspect in police custody on August 5th last in Nakhon Sawan shocked and horrified Thailand. The case raised unsettling questions about the sense of impunity which drove the city police chief and his subordinates to act in the way they did. Later revelations about the mid-level young policeman’s extraordinary wealth also painted a disturbing picture.

 

Ferrari Joe and his subordinates whose fate was relayed to them last week by a court verdict in Bangkok to the city’s central prison could still face a death sentence in a review by the Court of Appeal after six of the seven men including Police Colonel Thitisan Utthanaphon, received a life sentence for the murder under torture of drug suspect Jeerapong Thanapat in Nakhon Sawan on August 5th last.

 

That is according to Itthiporn Kaewthip, an official at the Office of the Attorney-General who told reporters last Thursday that the verdict and judgement in the case cannot yet be considered final.

You know this is just news to calm the public,  In all my years associated with Thailand, I have never seen an appeals court change a Life Sentence to Death  vice versa - yes, but not the other way around.  I go back to the early seventies where the death sentences were carried out in days after the court order by firing squad in Public, and televised on all three TV Stations...............somewhere along the way, they decided it was a bit morbid to televise it, so we had to settle for the graphic picrtures in the Thai Newspapers     Peace

My concern is that they'll use the new Personal Data Protection Act to release him somehow.

From what I can gather, the last prisoner executed in Thailand was 26-year old Theerasak Longji, who was killed by lethal injection on June 18, 2018, for aggravated murder.

Many arguments can be made for and against the death penalty. Everyone will make their own arguments, and even in democratic and humane societies there are discussions about this. At https://samploon.com/free-essays/death-penalty/ I have read some interesting and constructive articles about the death penalty. I advise you to read them too.

I am also not a supporter of the death penalty, but the situation here is complicated.

First start by seizing his assets and passport, then h.ng the culprit.

This will never happen so another one (like taksin, red bull heir, lady kai etc.) who will mysteriously vanish from Thailand.
