THE Administrative Court has accepted a lawsuit filed by a member of the Medical Council of Thailand and MPs from a few parties seeking to revoke the Public Health Ministry’s announcement removing marijuana from an official list of controlled substances, Naewna newspaper said today (Nov. 21).

 

Prof. Dr. Smith Srison, the Medical Council of Thailand member and president of the Forensic Medical Association of Thailand;  together with  Pol. Col. Tawee Sodsong, secretary-general of the Prachachat Party; Mr. Suthin Klangsaeng, Pheu Thai Party’s list MP; Mr. Nattawut Buaprathum, Move Forward Party’s list MP; Mr. Wirat Worasirin, deputy leader of the Seri Ruam Thai Party; and Mr. Nikhom Boonwiset, leader of the Thai People’s Power Party had together filed this lawsuit against Deputy Prime Minister-cum-Public Health Minister Anutin Charnvirakul and the Office of the Narcotics Control Board, as the first and second defendants.

 

In this lawsuit the court was asked to pass judgement on revoking the  ministerial announcement dated Feb. 8, 2022 that specifies the drugs on Category 5 narcotics list with cannabis to again be listed there according to the previous ministerial announcement dated December 8, 2020.

They’ll be protesting on the streets big time if this happens. Many Thais have spent a lot of money opening cafes and farms. This will not go down well.

Even " Move Forward Party " ... I did not expect them to be against the legalization ... anyway , that is a list of political parties NOT to vote for .

I agree, they are a very surprising inclusion. Even Pheu Thai you'd think would take a more enlightened stance. They'll lose a huge amount of votes of they succeed, and serve them right.

I personally don't use cannabis. But I'm surprised that alcohol and especially Thai whiskey isn't a problem... Why not? Because it is not allowed to sell it from 00:00 to 11:00 and from 14:00 to 17:00??? But ironically, for example, you can get it in any entertainment venue after midnight...

Make the same restrictions on cannabis. Problem solved. If it works with alcohol, it should work with cannabis too. Or are there other reasons why the much unhealthier and more dangerous alcohol is allowed?!

I doubt they'll be affected. You could always buy weed in Thailand. This is more to do with giving Thais the opportunity to start legitimate businesses, cleaning up the drug culture and safeguarding users. These politicians are blinkered idiots.

does Anutin own shares in the alcohol monopoly?

Will buying and smoking weed suffer the same fate as prostitution, gambling, and "grey areas" of immigration? Known to exist, but somehow tolerated. 

Personally, I don't touch the stuff. But my view is that the pendulum swung way too far to the left and into a full on free for all uncontrolled territory. That simply has potential repercussions at a minimum socially and economically. Medical use ... no problem. Smoking a bunch of high THC content joints and jumping into your 3.0L pickup and driving at 100kph .... nope. There needs to be balance and they are not there yet.

There are a couple of issues with the leagalization.  

 

Reading on here and the news the legalization was supposed to be for medical reasons which is not a huge issue.  I am aware and support CBD if used in medical issues.

 

The problem was that anutin and the PPP removed it and left it to the wild wild west style of action.

 

If this had been done properly and the medical community had had their input and were listened to.

If when it was legalized, it was legalized with the rules in place.

 

Imagine if they had opened up the toll way to motorcycles. 

 

Fact that Anutin was seen as a great thing, and most people at first thought did not care.  The problem was that there was not rules and we ended up with everyone and anyone selling the product and no control.

 

Remember, this is the same Anutin that said everyone should wear masks and got upset and said that Farang should not be allowed in the country

 

The solution is simple and is somewhere else.  

I think that the lawsuit is what is felt to be the best tool to get Anutin and his people off their assets and start taking the action that they want.

 

As to many people being upset, I think there are more people upset with the way it was opened than those trying to benefit from it.

 

 

 

This case goes well beyond cannabis it involves whether ministers are allowed to issue decees - if they win then the precedent will be set and every decree can be challenged and over turned. This will be a major shift in how Thailand is run. For example the decrees banning 3d printers, e cigs and hookah pipes can be challenged et al. Do the politicians realise the curbs on their power they'll be cementing into law?

 

Is the protagonist, Dr Srison, going to lay out a medical case for why it should be banned because so far all we've heard is innuendo of the supposed harms, none of which turned out to be true. Will he also clarify why Thailand is negatively impacted whereas The Netherlands, Portugal, Canada and large parts of the US are immune? And is he is stating the official position of the Thai medical council and is their representative on this issue or is this a private initiative? And who is paying for this lawsuit?

While I am all for legalisation of gunja, I am not for politicians making money off of it by legalising it and having HUGE interest in it.
