What is my best option
LOTS of reports on Facebook of people having issues, even with a non-O. But since the op is married, it should prove easier. Since a lot of the people with the non-O based on marriage who had problems were told if they were married to a Thai they would have been able to open the account. That is, unless the bank staff are just making excuses and will find a new one when a married person rolls up. -

BKK Bank 4 months banked method??
Fool you if you agreed and signed such a ridiculous agreement. On principal, I'd transfer my funds to a different bank even if it meant starting again by crossing a border, re-entering VE > Non O > extension. Then again, I keep my funds in Bangkok bank throughout the year, so it's not applicable to me. -

One day over stay
That depends on your definition of "overlooked." Generally policy at the main airports is that you will not be fined for a 1 day overstay, but you will still receive the overstay stamp in your passport. You might have a last ditch option. You can apply for an extension at Chiang Mai immigration even though you do not qualify for one. If they accept your application (they don't have to), they will then give you a stamp that says along the lines of "extension denied, you have 7 days to leave Thailand." This would prevent you from going into overstay.
