Judge Chuktan warns Trump against 'inflammatory' remarks before trial

Featured Replies

A federal judge has warned former US President Donald Trump against making "inflammatory" statements which could taint the jury pool ahead of his trial for conspiring to overturn the result of the 2020 election.

But Judge Tanya Chuktan ruled that Mr Trump can publicly share some of the non-sensitive evidence which prosecutors disclose to his legal team.

Friday's ruling was a blow to the special counsel who had expressed concern Mr Trump might reveal secret material and intimidate witnesses.

At a 90-minute hearing in Washington DC, the judge said the historic case was proceeding as normal.

"He is a criminal defendant. He is going to have restrictions like every single other defendant," she said.

"The fact that the defendant is engaged in a political campaign is not going to allow him any greater or lesser latitude than any defendant in a criminal case."

What Mr Trump can reveal publicly is one of several battles being fought between the former president's legal team and federal prosecutors.

What is a protective order?

Requests for protective orders are fairly routine in criminal cases. In many cases, defence teams are reluctant to oppose the orders because doing so would slow down "discovery" - the process in which prosecutors hand over evidence.

In this case, however, Mr Trump and his lawyers argued that his free speech was being stifled and argued that only sensitive information should be kept under wraps.

Judge Chutkan agreed. However, she said that his First Amendment rights was "not absolute" amid the ongoing case - and warned that she would not allow a "carnival atmosphere" at his eventual trial.

Why not throw his @ss in jail now? He has already violated the terms of his release, and he sure as hell isn’t going to respect this warning from the judge. Save us all a lot of trouble if Trump were in jail and barred from all forms of communication with the outside world.

And y’all say Thailands corrupt. I suppose he can’t run in 24 now…..????. Good job Biden is clean as a whistle……..????

You suppose wrong. Trump can run in 24. In fact, I think he's counting on it in case he needs to pardon himself..

If you or I had behaved like 45, you bet your bottom dollar we'd be in the gray bar hotel. His is a different situation. IF she threw him in the hoosegow, he'd become the greatest martyr since what's-his-name, that guy they nailed to a cross. From what I've seen, the judge is doing a wonderful balancing act.

No, far from it, just consider me a concerned forum member!  There's a lot of childish remarks and false comments (regurgitated left-media bias) on this topic.  Since you brought it up, I couldn't decided if your previous comments read like a totalitarian-dictator or just a nutter?

So your idol Trump can threaten and intimidate a judge and potential witnesses and violate the terms of his release, and I’m a totalitarian-dictator or a nutter for saying that he should be thrown in jail? Whatever happened to law and order? Isn’t that supposed to be one of the key values of the Republican party? Or doesn’t that apply to Trump, the wannabe totalitarian-dictator?

It has been pointed out several times on this forum already: Trump is being treated with kid gloves. If anyone else of us simple mortals had pulled anything even remotely close to what the Donald has been getting away with, we’d have been in jail a long time ago. Talk about your two-tier justice system….

The people in the media are on "insult watch" just waiting for his nibs to blow it.  Don't think Fox would balk at being the ones to take credit for the scoop.

Maybe Chuktan will transfer the case to juvenile court.

I understand your point, although I disagree.  No intimidation, the court wants to silence the defendant & still call it a public hearing, and that's not politically motivated?  I don't believe there was any violent intent behind his remarks, although most of the media would have you believe this narrative.

I retract the nutter comment & apologize if you're offended, nothing personal. However, I've noticed a prevailing trend of comments on this forum that exhibit a noticeable left-leaning bias and occasionally convey a tone of animosity & hate, which can detract from productive discourse.
Idolization? Not at all, I'm just another putter willing to throw my opinions out there, and those left-leaning perspectives might just want to suppress that.
You want to talk about two tied justice, do you have an opinion on Hillarie''s emails, Joe's alleged removal of classified documents (as a Senator), or perhaps the millions of overseas dollars linked to the Biden family through bank records and shell companies, what service did they provide, why did they rack up over 150 SAR's, and what's going on regarding the Burisma allegations?

What you call "left-leaning" is just stating the truth. Next time you witness this "left-leaning bias," I challenge you to factually debunk the facts (and not just repeat Fox NOT-news regurgitation). The references you stated here have been put to rest time and time again yet Fox keeps spewing them out until they get sued for hundreds of millions of $$$.

Characterizing the content as 'stating the truth' from left media sources is delusional, as expected.  If you bothered to pay attention and invest time in observing unedited senate hearings (incl. witness testimonies) & house floor debates rather than relying solely on heavily edited media, you might gain insight not readily available through those sources, and possibly question your so called 'truths'.

Nice deflection but, again, no actual facts. What you consider "heavily edited media" is only objectionable to those whose personal narratives don't like their points.

Certainly not politically motivated.

trump is out on bail, and as such he is governed by those bail limitations, no different than any other defendant on bail regardless of their political orientation.

What trump is doing is trying to poison the well, and then claim that the well is poisoned and we need a new well.

Judge Chuktanis is no  Aileen Cannon (assigned 1,810 cases and issued opinions in 616   ) , She will have none of that.

Cannon .(  assigned 224 criminal cases — only four of which went to trial,  ) on one of these four she forgot to swear in the jury pool, In another he closed the jury selection to the public violating the defendants 6th amendment rights.

Another of trump's "Best person " appointment. He probably used the "best words" when he made the appointment, because he is a "stable genius"   :cheesy:

You were right, but the playing field has just been upset. The good news is that two Federalist Society, Right-wing judicial scholars join together and write a 126 page article citing in great detail why the 14th Amendment to the US Constitution is self evident to apply, that Donald Trump is DISQUALIFIED to hold ANY OFFICE in the USA. Those on the political left have said since the insurrection in 2021., But this time it is coming in a way that will prompt and win suits in many states - to remove his name from any ballots.

This shift in landscape, coming from the political right, is earth shattering bad news for the former president, ... and many others in congress who supported his conspiracy.

To the above:

Conservative Case Emerges to Disqualify Trump for Role on Jan. 6
Published Aug. 10, 2023 Updated Aug. 11, 2023

But James Bopp Jr., who has represented House members whose candidacies were challenged under the provision, said the authors “have adopted a ridiculously broad view” of it, adding that the article’s analysis “is completely anti-historical.”

(Mr. Bopp’s clients have had mixed success in cases brought under the provision. A state judge, assuming that the Jan. 6 attacks were an insurrection and that participating in them barred candidates from office, ruled that Representative Marjorie Taylor Greene, Republican of Georgia, had not taken part in or encouraged the attacks after she took an oath to support the Constitution on Jan 3.)

Right now I don't think it matters much whether they're wrong or right, but that may change soon.

What matters right now is that support for Trump from his traditional backers may be dwindling.

Sure but as I have linked before, there are some hard core backers who see Trump as the vessel for their re-workings of the government:

Trump and Allies Forge Plans to Increase Presidential Power in 2025

The agenda being pursued has deep roots in the decades-long effort by conservative legal thinkers to undercut what has become known as the administrative state — agencies that enact regulations aimed at keeping the air and water clean and food, drugs and consumer products safe, but that cut into business profits.

“It would be chaotic,” said John F. Kelly, Mr. Trump’s second White House chief of staff. “It just simply would be chaotic, because he’d continually be trying to exceed his authority but the sycophants would go along with it. It would be a nonstop gunfight with the Congress and the courts.”

When I read reference to MTG and the Jan 6th attacks I always think of her statements after the fact:

Rep. Marjorie Taylor Greene said at a Republican event in New York over the weekend that if she had organized the Jan. 6 attack on the U.S. Capitol "we would have won" and "it would've been armed," according to video from her appearance that was posted on social media.

Two judges from the Federalist society wrote that Trump is disqualified from holding office under the constitution. It is ultra significant that Federalist Society judges would speak out against Trump. He's toast

I would like nothing better than see Trump red-carded but the quote I put in above is from someone who had to try these charges in Court and he says: Not so fast.

My comment was in reponse to "his traditional backers may be dwindling".

Well if Judge Chuktan decides that Trump has violated terms of his bail release orderand revokes bail, I guess she can send out a US Marshall squad to find him and return DJT to the Judge's venue.
