CharlieH Posted November 11, 2023 Share Posted November 11, 2023 A federal judge in Florida, for now, declined to delay the start of former President Trump’s criminal case over his handling of classified documents, though she did push back several pretrial deadlines in the case. U.S. District Judge Aileen Cannon ruled Friday that she would dismiss the motion from Trump’s legal team “without prejudice” against taking it up again in the future. The trial’s start date could be reconsidered at a scheduling conference March 1, she wrote. The order is a small victory for special counsel Jack Smith’s team, which had strongly argued against any delays in the case by suggesting that the former president wanted to push the case until after the 2024 presidential election. Trump is the undisputed front-runner in the GOP presidential primary. When Cannon heard arguments about a potential delay earlier this month, she appeared ready to side with Trump’s attorneys’ request to postpone the trial, saying she “has a hard time seeing how realistically this [current schedule] would work.” The Florida judge noted the 1.3 million pages of evidence — plus thousands of hours of security video shot at Trump’s Mar-a-Lago resort — that prosecutors in the Mar-a-Lago case gave to the defense in discovery, in addition to the former president’s other legal woes with schedules of their own. “I am not quite seeing a level of understanding on your part to these realities,” Cannon said at the time to prosecutor Jay Bratt, a member of special counsel Jack Smith’s team. Trump’s classified documents trial is scheduled to begin May 20, a little over two months after his Washington, D.C.-based trial on charges linked to his efforts to overturn the 2020 election is set to begin, March 4. Trump’s criminal case in New York over a hush-money payment is set to head to trial March 25, and a trial in Trump’s fourth criminal case, linked to his actions in Georgia after the 2020 election, has not yet been scheduled. His only chances are a hung jury, or delay past January 20, 2025 (assuming he wins the presidential election). What is never discussed is the long delay between conviction and sentencing. What I think we are going to see next year is Trump nominated by the GOP - even if he has been convicted by a jury, he loses the presidential election, suffers more convictions, and then spends the next few years delaying incarceration. I certainly know of no theft of document charges against former President Trump. When was he charged for theft of documents? The docs that the PRA grants him absolute plenary powers to declassify and possess, meaning ANY presidential records, docs, and so on but please share the document theft charges you are fantasizing about. FYI, a little analysis of the ongoing court dates stick handling could reveal a brilliant strategy playing out, right into the hands of yours truly. You can start by thanking the judge in Florida and her recent ruling(s). Think a little on it and consult with your informed colleagues to guide and advise you and don't forget the theft of document indictment. Just because there are no criminal penalties under the PRA, that doesn't mean Trump was entitled to have them. The law is very clear about that. Willful possession is a violation. If you refuse to return the documents when they are requested by NARA, that's also a violation. And why exactly do you think it's not a criminal act to lie to the Justice Dept in the course of an investigation? J6 is scheduled for March as is the SDNY/Bragg nuisance charge and IF J6 gets delayed for Trump petitions and appeals, of which there are several VERY contentious issues and this delays, postpones the J6 trial start date....the FL judge did Trump a solid, since her case. unless dropped will take several months during which time there can be no means to schedule in the J6 trial, until later in the fall, within 90 days of the election in which case it gets scheduled after the election. This is very realistic and squares perfectly well with a Trump election victory.
