Shamima Begum Loses Appeal Against Removal of UK Citizenship

 

Shamima Begum, the east London schoolgirl who travelled to Syria in 2015 at the age of 15 to join ISIS, has lost her appeal against the removal of her British citizenship. The 24-year-old's legal battle is expected to continue despite the latest ruling.

 

Background:
- Begum's citizenship was revoked on national security grounds after she was found in a refugee camp in 2019.
- She lost a challenge at the Special Immigration Appeals Commission (SIAC) last year but appealed to the Court of Appeal in October.

 

Court Decision:
- Dame Sue Carr, one of the appeal judges, affirmed the commission's decision and dismissed Begum's appeal.
- The judge acknowledged the possibility that Begum may have been influenced by others but stated that she had made a calculated decision to align with ISIL.
- The court's role was to assess the lawfulness of the deprivation decision, not to agree or disagree with its severity.

 

Legal Representation:
- Begum was represented by Samantha Knights KC, who argued that the government had failed to consider its legal duties to a potential victim of trafficking.
- The Home Office, represented by Sir James Eadie KC, emphasized national security as the key aspect of Begum's case.

 

Future Legal Steps:
- Begum's legal team is likely to appeal the latest ruling, with arguments over the consequences of the judgment adjourned for seven days.

I have limited sympathy for Begum, what she did was frankly stupid. She was only a teenager, and long experience of teenage girls ( as a father and teacher before anyone gets too frothy mouthed) leads me to be aware that at times they make the stupidest decisions for the flimsiest and silliest (sometimes stupidest) of reasons. I think this was one such case.

 

She has lost three babies I believe, and that in itself is punishment enough, if punishment be required.

 

Revocation of her citizenship was a political decision, driven by a desire to appease the tabloid press. It should be reinstated. She can then return to the UK, and rebuild her life. If she acts to jeopardise national security then there are ample laws under which to prosecute her. Leaving her to rot, stateless and destitute in a refugee camp will solve nothing, not serve to establish an effective precedent in case law.

 

I have to say that I find it difficult and depressing to find myself in agreement with Gareth Pierce "et al" but there we are.

 

One final point, a philosophical one perhaps, and one which I am sure many will scoff at: she joined, and was later subsumed into ( perhaps against her will) a society which seeks to replace our civilisation, based on Judeo- Christian values which include mercy, with one based on barbaric savagery and intolerance.What better way to emphasize the superiority of our society than to show her mercy.

Shamina made a bad decision but after a few days or weeks there with ISIS, did she show her regret and wish to get out in her emails to friends and family? If she did, some sympathy. But it seems she didn’t at all. If ISIS hadn’t been crushed, likely she would still be an active member. The right decision by UK courts.

This ruling was about the lawfulness of the previous rulings. Morality wasn't looked at and I presume will also not be looked at if the legal battle continues. But I thought this was the highest court, what else is there to appeal? Surely there must come an end to this.

Did she marry a Dutch terrorist (that's what ISIS is), what's happened to him, did the Netherlands accept him back?

As for having 3 babies, I personally don't believe a word, and dressing herself in Western clothing for the interviews, more sympathy seeking nonsense. Married at 15yrs old, bit old for that according to Islamic law.

Let's not shy away from the fact that these three KNEW what ISIS was doing, slaughtering.

That's revealing..

The court's decision that the cancellation of her UK nationality was legal is correct. I don't, however, agree with the original cancallation which was a publicity stunt to appeal to the baying mob. She is a Brit and should gave been allowed to return to the country of her birth, and to face trial there based on the available evidence.

Very well, she could have been "a  potential victim of trafficking". Using the same argument, she could have been a potential Terrorist. So much for potentiality and its use to create sympathy.

I remember the whole thing she voluntarily under no pressure went there. She made her decision, and now she wishes she didn’t well too bad I feel no sympathy for this lady whatsoever.

While I totally encourage young people to travel off the beaten track, to experiment with different lifestyles, to “feel their oats” (if that’s the right expression), joining a terrorist gang and having their babies is probably stretching it. John Walker Lindh, the “American Taliban,” comes to mind -- I think he spent nearly 20 years in a US jail and was recently released.

 

That said, I agree with you: I think that the UK should demonstrate why its culture is superior to that of ISIS (or religious extremism of any stripe) by showing mercy to this woman.

Next we need to cancel the Citizenship of a few more people who are still in the UK.

You may be right -- she said in the video someone posted above that when went, she thought she was going to “make a family,” but there would have been such a gaping power imbalance between her and the men who were handling her in Syria that she likely had little say in the matter, and even the British judge who ruled against her admitted that there was a “credible suspicion” that she’d been trafficked to Syria for “sexual exploitation.”

 

In any event, I seriously doubt that she poses any threat to British national security -- if anything, she may need some therapy!

She’ll eventually win her case.

 

Stripping a person of their citizenship on the basis of their actions as a child will clearly not stand, not should it.

Granted what she did was the height of stupidity but at 15 with a home background and a future like she would have faced it, may have been just a lark to begin with.

 

What 15 year old nowadays or even then know what they want yo do for the next 50 or 60 years of their lives.

 

Having said that I still wouldn't want her back in the UK.
