Trump wins last-minute reprieve as judge cuts fraud bond to $175m

If Trump successfully posts the bond within the specified time frame, his assets will be protected while he continues his appeal process.

Had Trump failed to post the bond by the deadline, it would have empowered New York Attorney General Letitia James to commence freezing his bank accounts and seizing his properties.

 

While the court's decision grants Trump temporary relief, the original $464 million judgment against him, along with interest, still stands. Additionally, penalties such as barring Trump and his elder sons from running businesses in New York remain in place, although enforcement of these penalties has been delayed.

 

Trump's financial situation has been under scrutiny, with conflicting reports about his available cash reserves. Despite Trump's claim of having as much as $500 million in cash, his legal team asserted that he was unable to cover the $464 million penalty, despite approaching numerous financial companies for assistance in securing a bond.

Trump’s Bond in Civil Fraud Case Is Reduced to $175 Million

David B. Saxe, a former judge on the appeals court that ruled on Monday, said that the court’s decision to short circuit Ms. James’s collection efforts suggests that some of the judges were uncomfortable with Justice Engoron’s ruling.

 

“My view is that the court indicates it has difficulty with the breadth of the lower court’s decision,” said Mr. Saxe, who retired in 2017 after 36 years on the bench, 19 of them on the appeals court.

 

“They had other options available to them, and they issued a broad-based stay,” he continued, which he said suggests “that there is a view that they’re going to need to take a hard look at the lower court’s decision.”

Maybe the Appellate Court agreed with the Trump brief that Judge Engoron ignored the Appellate Court's prior ruling on Statute of Limitations and substituted their own definition for the Appellate Court's definition.

Actually, the Appeals court ruling makes sense, if you believe they will ultimately reduce the verdict.

Trump has already appealed the judgement, there was absolutely nothing stopping him from doing so.

 

The ‘Bond’ is simply to prevent NY collecting on the penalty while Trump’s appeal is in process.

$464 Million was set so high in order that he couldn't meet it and they could begin collecting on it while his appeal was still in process. Hardly a fair process. What happens if he wins the appeal, he can buy back all the properties he sold at fire sale prices to stop them collecting? Of course not.

The penalty was calculated on the basis of the fraud’s Trump committed.

The collection process will almost certainly take a great deal longer than the appeal.

 

It’s first outcome would be to reveal exactly what assets Trump owns and what is in hock. Actually collecting on the penalty is a way off yet.
