His argument is just an argument that has no practical basis. I have demonstrated how Trump is considered a convicted felon on a practical basis in many states, including FL, and based on his inability to vote in several states, an inability to serve jury duty, and an inability to travel (if those countries were to enforce now, but they won't). Plus he's been CONVICTED OF A FELONY. That the judge will enter the judgment of guilt is a technical issue, and even that lawyer admits its automatic. That lawyer is making an argument of a literal technicality (I remember when right wingers hated technicalities) and he's a complete right wing blowhard who is obviously lying when he says:
