I would bet money if the case was not publicized so much that he would be demanding exorbitant fees. The case was a no-brainer. HOw the foreigner avoided a guilty charge in the first court is beyond me however, I suspect influence was used there. I am also curious, does he get kicked out of Thailand and visa revoked and black-listed? You didn't read the article to the end did you" He's long gone. 1 1
ThailandGuy Posted Saturday at 10:25 AM Posted Saturday at 10:25 AM 2 hours ago, Reddavy said: The case involved Dr Tanradao Jandam, known as Dr Pai, who accused Urs 'David' Fehr, a Swiss citizen and owner of a Phuket elephant park, of kicking her in the back and hurling abusive language at her. The “beach bully” incident, as it came to be known, was captured on a phone video, leading to a public outcry and calls for Fehr’s deportation. Fehr has always maintained that he slipped on the steps and his leg came up in the air, which gave the appearance on the video that he was delivering a kick. Mr Niphit said the Court of Appeal Region 8 delivered its ruling on Friday, sentencing Fehr to one month in prison, without suspension, under Section 391 of the Criminal Code, which covers assault that does not cause bodily harm. His actions constituted a serious offence, according to the court. The Provincial Court was scheduled to read out the appeal court’s ruling on Wednesday, but Fehr failed to appear, prompting the court to sentence him in absentia. Authorities believe he has fled the country. The Fehr incident also raised concerns over encroachment on public land. Investigators found that the steps leading down to the beach were not part of the villa property and had been built illegally. They were later demolished. Local residents subsequently called for authorities to do more to return public access to beaches on the resort island. I have no sympathy for Urs 'David' Fehr or what he have done. But if a Thai had done the same to a foreigner, the punishment would have been a slap on the wrist, or in worst case a 500 Baht fine with no jail time served. It seems like the Thai judicial system likes to punish foreigners for things, that a Thai citizen would easily get away with. In my humble opinion, such two tier behaviour will make many foreigners consider one extra time, before travelling to Thailand to spend their money. 2 1 2

These are the infamous steps? In my mind I imagined some tiny narrow steps that were completely blocked by the Thai and hence the anger shown by the Swiss guy. Even though they are on public land how on Earth could the Swiss bully have objected to somebody sitting on them. 1 2

If he really did slip, he only needed to apologize profusely and there would have been no arrest or court case or jail time. I wonder if he'll learn from this experience. Some people never learn, say no more Then again he might have been afraid of something happening to him in jail, I think he would be deported after doing his time 1

The case involved Dr Tanradao Jandam, known as Dr Pai, who accused Urs 'David' Fehr, a Swiss citizen and owner of a Phuket elephant park, of kicking her in the back and hurling abusive language at her. The incident occurred on 24th February 2024 while Dr Pai was seated on the steps of a luxury villa at Yamu Beach, in the Pa Khlok area of Thalang District, Phuket. Initially, the Phuket Provincial Court dismissed the charges on 3rd September 2024, citing reasonable doubt in favour of the defendant. Following this decision, Dr Pai’s lawyer, Nipit Intrasombat, lodged an appeal. In the latest development, the Court of Appeal has found the defendant guilty under Article 391 of the Thai Criminal Code, recognising the severity of the assault and imposing a one-month custodial sentence without allowing for a suspended sentence. Mr Nipit expressed his gratitude to all involved in the case, including the investigators, prosecutors, court officials, original and defence lawyers, acknowledging their dedication. He emphasised that the differing views in the case were purely based on factual and legal grounds, not personal animosity. The verdict is a vindication for Dr Pai, who persevered with patience and fortitude to seek justice. Mr Nipit noted that he undertook the appeal without charging for travel, airfare, documentation, or legal fees, understanding the sentiments of Dr Pai, the people of Phuket, and all Thais regarding this case. Reports indicate the defendant has fled the country despite the court's arrest warrant. As in any nationality - some of them are - for instance, look at some of the cases you read about where the Thais do awful things to their children.Or the cases where Thais team up to beat the s**t out of some foreigner for some slight demeanour. Or the myriads of cases where "ladyboys" assault and steal from foreigners in the "family friendly resort" which seeems to be anything but. Personally, I have never come across any of these "horrible, evil, disgusting awful people", but as the posts in AN and other media show - they do exist!
