Getting guardianship of a partner who has dementia

Featured Replies

Does anyone have experience getting guardianship of a partner who has dementia or who has become incapacitated in some other way? Both partners are expats.

Depending how far dementia have evolved. Best thing to do, ask embassy about how to legally proceed.

To gain guardianship over an expat spouse with dementia, you'll need to initiate legal proceedings in the appropriate court, typically where your spouse resides. A lawyer specializing in guardianship is crucial to navigate the process, which includes filing a petition, providing medical evidence of dementia, and potentially attending a court hearing. The embassy generally cannot directly intervene in guardianship matters, but they can provide information on local resources and legal assistance.

Maybe mixing things up with how it works in other countries? In Thailand its possible but a long process thro the Thai courts entails.

Once a person is deemed legally incapacitated, they can no longer grant POA. So the document must be executed while the individual still has legal capacity.
