In a dramatic new hearing on December 1, Luigi Mangione sat before a Manhattan court — not to stand trial, but to fight the admissibility of critical evidence tied to the killing of Brian Thompson, a former executive of UnitedHealthcare. Prosecutors played 911 call recordings and restaurant surveillance video documenting Mangione’s arrest at a McDonald’s in Altoona, Pennsylvania, just days after Thompson’s December 2024 shooting in Midtown Manhattan. 

 

The evidence under dispute includes a 3D-printed handgun with suppressor, a handwritten journal praising anti-health-insurance beliefs, and other items discovered in a backpack police allegedly searched without a warrant. Mangione’s lawyers argue the search violated constitutional rights, and that any statements made before he was read his Miranda rights should be excluded. 

 

The hearing also revealed unusual prison conditions: a corrections officer testified that Mangione was placed under continuous 24-hour observation in a high-security facility, explicitly to avoid a “suicide or death-in-custody” risk — drawing parallels to the infamous Jeffrey Epstein case. 

 

Previously, a judge dismissed the state’s top charges — first- and second-degree murder as acts of terrorism — citing insufficient evidence. However, Mangione still faces nine other charges, including second-degree murder, which could carry decades behind bars. 

 

As this high-stakes evidentiary hearing continues, the judge’s ruling could determine whether prosecutors retain their strongest evidence. If the defense succeeds, the upcoming trial may look very different — and prosecutors could lose key pieces of the case against Mangione.
