    It sounds as if you already have talked to the owner of the trees, and he was not forthcoming. Normally, rubber trees would not be planted right to the land border, so I am a bit surprised about this

I do this with work colleagues, I start off by telling them to keep it to themselves then tell them I don't really want to say anything but Jack or Jimmy or whoever was bad mouthing them behind their backs !

I just cut what's overhanging and then get rid of it myself.

I have seen them planting as close to the land border as possible go to extremes here, one farmer that had the main highway(Surat Thani to Krabi) running through next to his border dug out the angled base support for the road running through a gully so it was perpendicular to the road to plant 1 rubber tree. Needless to say the road ended up collapsing and one lane was blocked off while they reinforced the base for some time, have also seen where they have built their house right along the road then put up a veranda that actually over hung the road, seems they think if they own the land they can use all of it to the extreme and ignore the laws.

Technically, you are guilty of theft if you do not return it. In reality they would probably thank you.

Bredbury Blue has the best advice, but I would add the Phu Yai Ban (village headman) to it. So that means the steps would be:

  1. Do not cut the branches.

  2. Talk to your neighbour - if you can - and ask them to trim the branches giving them plenty of Thai Time. Record details of the talk - time, place, participants and what was said.

  3. If that fails or cannot be done, email your neighbour - if you can - and ask them to trim the branches giving them plenty of Thai Time. Save the email and any response.

  4. If that fails or cannot be done, talk to your Phu Yai Ban and, if necessary, show him/her the problem and any records of discussions with your neighbour.

  5. Follow their advice, but if you disagree with their advice, then you have a problem. You need to have the phu yai ban involved in case of the problem escalating.

As Thai Law Online states " The phu yai ban is the lowest level of Thai administrative authority, responsible for maintaining public order, resolving minor local disputes, and witnessing certain civil transactions such as land-use rights and private loan agreements in rural areas."

The simplest solution: I gave my neighbor a one-week deadline according to Section 1347 of the Civil and Commercial Code Thailand, which he ignored. So I gave my gardener 500 baht and he cut everything back. No problem!

Yeah but there are many around here that are too scared to exercise sensibility. And if branches are landing on your house then you certainly don’t need to notify anyone as it’s a hazard.

I imagine the OP has to hire a cherry picker and then hire a person to cut the branches etc

Is it his responsibility,?
