Hi... Perhaps somebody can think of a simple solution or point me in the right direction??? I (48) male have lived in LOS for 3 years with my (46) English wife basically doing tourist visa runs etc... My daughter (22) married a Thai man last year in Bangkok. She worked in a school as a teacher earning a good wage of 60k. They had a son recently and he has Thai nationality and a british passport... It took the electric to be cut off, UBC disconnected and water and phone to be turned off for her to realise that this wonderful husband of hers has been fleecing her for a long time!!! She was staying here on a marriage visa but now he has done a runner or blended into the background in bangkok apparently with a new woman and a new shop i have no doubt my daughter financed... The Samui immigration told her that when she needs to renew her visa she needs her husband with her!! problem!!! So she and my grandson are living with us and we are supporting her whilst she starts a new playschool... The question is::: She is supporting her son who is a Thai national in fact I am, can she get a visa to stay here for this reason or does she simply hand over the baby to immigration as she is refused her marriage visa!!! Letting them know that he is thai and a simple stampin her passport would solve the problem~!!!!

I believe that she can convert the marriage visa to a non imm B visa based on her work at the school. The school should provide docs for that.

When she has that then she can apply for her WP and thereafter her visa extension for up to 1 year.

Thanks for the reply but she is no longer in bangkok or working there after going through a traumatic and very expesive time with her ex!! She is living with us at our house in Koh Tao.. She is having a playschool built but there will be an overlap before she can set up a company and do a wp etc..

Is there no visa that is designed for supporting a thaichild??? Like a familly visa where i can just provide proof of income for all of us and we just carry on as we are... i have been stitched up by the retirement visa rules but thats life here... This is not ploy to sort my wife and myself a visa out on the back of this tragedy, we will just get around it as most people do...

Myself I am ex army on a pension of 65k ish per month so need no job or other income.

i've got a non-o visa from a consulate outside the country valid for 3 months for simply showing the birth certificate of my son naming me as the father. this non-o is now being used to apply for a WP

That was what went missing in the Police Order 606/2006 that we are now operating under - no provision for support of a Thai child.

Currently only non immigrant visa stays of 90 days each would be allowed.

Ministerial Regulations B.E.2545, section 34(15)(2) appears to be the basis for issue of visas for those supporting a Thai child (link). Police Order 606 allows extension for only those parents who are age 50 or above. It makes no such age requirement for those supporting a wife or husband.

Edit: the above said she should talk with immigration as high level exceptions are sometimes made and it can not hurt to try.

If the local immigration say she cannot pitch up for visa extension with the paperwork alone but needs her husband present then she cannot act as if she is still married (even though she is).

Technically within the regulations she has no choice but to go for the Non Imm and subsequent 90day border runs (She should have no problem applying for this showing her Thai childs Thai passport/birth certificate with her named as mother but as a single Mum will she be expected to do the visa runs with littl'un in tow?( who will look after her child?)

As Lopburi suggests some immigration officers can be helpful in the situation and it may be worth explaining what has happened and see (if just for this once until the business is set up) they might be able to compassionately help.

Maybe also recompose your post above and perhaps your daughter can get some support and advice from the lady members in the 'Ladies in Thailand' forum here on Thai Visa. Some may have been in a simlilar situation and can help with the ultimate outcome too.
