Phill,

Your wife has to make an application to the BIA for permission to stay longer. Providing the application is in order, she will be allowed to stay for a further period of two years. Complete form FLR(M) and read the guidance notes.

Thanks for the good wishes :o Another question though! She wants to go to Thailand mid January staying 4/5 weeks in preparation for her Graduation early Feb! Will this be a problem?

It might be. If your wife leaves the UK without getting her two-year stamp first, she'll need another settlement visa in order to come back at a cost of another £500.00. If she applies for her extension now by post, there is no guarantee that she will have it back in time for her to travel to Thailand in mid-January. You may wish to consider using the same-day service at one of the BIA public enquiry offices and apply in person.

Just sent everything special delivery today :o I suppose i can call them about the 10th if i have heard nothing and make an appointment! might be woth the extra £200.

So just to clarify,after her 2 year stamp she can travel with no problems?

On the understanding that your wife continues to meet the criteria for spouses, then, yes, she can come and go as she wishes within the two years without needing another visa.
